Minkner & Partner have opened new office premises in Pto Andratx on the harbour Promenade, Avenida Mateo Bosch,8,

 

As one would expect from a professional company, Minkner & Partner have opened new premises in Pto. Andratx, in the Avda Mateo Bosch 8, right on time. This was a “low key” opening as the official opening will take place on 24th of February. The new premises will be run by our sales manager, Matthias Neumann who has a degree in business studies, and his team: Luis Pitarch, Renato Cerullo, Oscar Chuctaya, Maria Schmidt, Serafima Joel and Anjela Grinyuk.  The Andratx team are supported by Marvin Bonitz, Sales Director of Minkner & Partner, who will also be an important contact for the regional property developers.

 

The new opening is accompanied by a large marketing campaign for real estate located in Pto. Andratx and the surrounding area. On the 23rd February there will be a special edition of MALLORCAS TRAUMIMMOBILIEN with over 50.000 copies of the magazine dedicated solely to the Andratx region. This will be included as a supplement in both the MALLORCA MAGAZIN & MALLORCA ZEITUNG newspapers.

 

Marvin Bonitz had a very impressive end of year sale!  The property in question was an extremely prestigious “double figures” million euro villa in Puerto Andratx and was sold to a German entrepreneur. Marvin, from Minkner & Partner management, happily announced “the year has only just begun; my team and I have a lot planned for 2017!”

 

2. Mallorca – Construction, Economy laws and taxes

 

(1) Construction / Investment

 

Delayed application processing in the town halls, prevented 113 million investments.  Laziness or intention?

 

The President of the Hotel Association of the Balearic Islands, Inmaculada Benito, has launched a strong attack against the Balearic Government and the responsible officials in the municipal town halls. According to her information, planned investments of 113 million euros will be suspended and postponed until the winter of 2017/2018. The reason for this is that the construction departments of some town halls have taken up to 18 months to issue building licences, while the conservative government took approximately 6 months to issue the necessary licences. The town halls of Palma and Calvia were particularly slow. The consequence is that numerous construction contracts could not be granted, which  leads to a considerable economic loss. Benito suggests that she is not sure whether this is due to laziness in Calvia and Palma town halls or whether the delay is based on intent, because the left wing government has so far shown "lack of sensitivity to the needs of the tourism industry".

 

16 Million Euros has been invested by the Islands council for the development of cycling pathways and roads

 

Mallorca's island council is worried about the security of cyclists, who also form an important part of tourism on Mallorca. For this reason, they have set aside 16 million euros in the new budget for this project. These means are intended to improve cycle paths and roads which are constantly used by cyclists, especially in the Tramuntana Mountains. Furthermore, on some of the country roads, the hard shoulder will be broadened. On numerous roads the grip of the asphalt is to be improved, which should benefit not only cyclists, but also drivers. 

 

Pto. Andratx: Calle Levante is to be extended to relieve the road of the harbour promenade

 

During the summer season the harbour of Pto. Andratx is very busywith traffic along the seafront. Waiters, who need to cross the road to serve clients on the terrace waterfront, risk their lives on a daily basis.  The governmental alliance of PP and Pi, which is currently in charge in the town hall of Andratx, now want to put an end to this by lengthening Calle Levante to create direct access to the urbanization of La Mola, Valleluz and Cala Marmacen. Construction work is scheduled to start in mid-January 2017 and will be completed by the start of the summer season. An initial budget of € 700,000 is provided.

 

Calvias town hall is planning a Skate- Park

 

Calvia town hall is planning to build a skate park on a 1,200 m² plot near Galatzo, the urbanization close to the windmill at the exit to Calvia, Santa Ponsa and Andratx. This would make Calvia a centre for international skate boarders. The idea was inspired by the fact that skateboarding will become an Olympic discipline as of 2020. The necessary investment is € 350,000.  The Conservative as well as the Liberal party have criticised stating that such a facility is oversized for the municipality. It is also doubtful that Calvias attractiveness will be increased.

 

Palma:The Sa Riera Stream  

 

Already one year ago, the city of Palma presented a project to build a city park with a surface area of 34,000 m² close to the Avenidas, to act as a "green area” for Palma. This project has now been incorporated into a larger one, including Sa Riera which will also form part of this “green corridor.” The project has now been submitted to the EU under the subvention programme ‘Life’ which is intended to make a small contribution to climate changes. The planting of 4,000 trees is intended to compensate for carbon dioxide emissions. The total investment is quoted as being 3.8 million euros, of which the city is to pay 1.3 million euros and to finance the rest from EU funds.

 

Palma- Inca: Another motorway section to have 6 lanes

 

Construction work on a section of the motorway between Palma and Inca has begun. It is a section of approx. 6 km in the area of Festival Park in Marratxi, which is to be increased to 6 lanes. Construction work is expected to last three to six months and will cost 2.7 million euros. Since the construction work is done at night, the traffic is redirected during these hours.

 

(2) Economy

 

Tourism I:In 2016 there were 13 million tourists visiting the Balearics

 

So far, only the figures for the period January to November 2016 have been made available. During this period, 12.9 million tourists visited the Balearic Islands. This is 12% more than in the same period of the previous year. In the 11 months of 2016 Spain had 71.6 million visitors. This is 10.1% more than in 2015.  For the month of December booking numbers were high for the Balearics; so the 13 million mark will definitely be exceeded.

 

Tourism II: “Low cost Airlines” brought 5, 8 million guests to the Balearic Islands

 

With Air Berlins final departure from Mallorca, the market shares among the airlines were already redistributed in 2016. In the months of January to November 2016 the Balearic Islands handled 12.9 million passengers, an increase of 12.9% compared to 2015. 5.8 million Passengers used low-cost airlines such as Ryanair, Vueling or Easyjet. This is an increase of 18.9% compared to the previous year. Experts believe that in 2017 more passengers will use low-cost airlines rather than traditional airlines.

 

Tourism III: The Gran Hotel in Soller has a new owner. Gelabert is staying on Board of Directors

 

The Gran Hotel Soller has a new owner. A French company “Group Sermeta” has bought the 5-star hotel for 10 million euros, said Andreu Gelabert, the former owner. However, Gelabert remains the company's managing director. Sermeta intends to expand the existing hotel and also wants to purchase other hotels on Mallorca. The employment contracts were honoured. The emblematic building dates back to 1880 and has been used as a hotel since 1960. Gelabert bought the property and opened in 2004 the Gran Hotel Soller as the first 5 star hotel of Soller.

 

Wine production 2016: A record year despite unhelpful climate conditions 

 

2016 was a record year for Mallorcan wine growers and bodegas. Despite unfavorable climatic conditions, the balance sheet shows a production of more than 6 million litres. This means that production was 10.2% higher than the previous year. Per hectare, winegrowers recorded a yield of 5,897 kg of grapes. Almost half of the grapes (44.5%) were processed into red wine, 30.5% to white wine and 25% to rosé wine. Over the past ten years wine production has increased by 25%.

 

(3) The law taxes and finance

 

Corruption is indiscriminate – the shameful example of the President of the Balearic Parliament Xelo Huertas (Podemos)

 

My grandmother never trusted any politician ... “put them all in one sack and hit it hard, you will always hit the right one!“  How right she was! This was confirmed by the example of the current President of the Balearic Parlament, Xelo Huertas.  Podemos, the left popular party, gained power by promising to end corruption in Spain.  Only a short time in power and it was discovered that Podemos was involved in a well-known scandal!  Parliament President Huertas had used her position to encourage, push and sign a questionable contract between the Balearic Parliament and a pharmaceutical company which belongs to a Podemos politician. The lady in question was thrown out of the party when the deal came to light.  Huertas however, refuses to give up her position and mandate as Parliament President.  “Corruption is the pathway which runs parallel to the chain of command“.

 

Illegal Holiday Rentals

 

The left government has announced that they will adopt a new holiday rental law in April 2017.  The timetable will be difficult to meet as the islands council has announced a long trial period.  Biel Barcelo the Minister for Tourism announced that the government wanted to take action against illegal holiday rentals even before the law came into effect. It was recommended to diligently check all offers of holiday lets in the internet, as many of these holiday rentals offered had not been registered with the authorities.  Such offers would, on one hand, deprive or render unjustifiably expensive valuable housing for the home market, and on the other hand a considerable loss of income and tourism tax for the state.  Biel said that the Government currently want removed some 31.000 illegally offered apartments. There is also the option of obliging websites to advertise only those properties that are registered with the authorities.

 

The European Court of Justice will collect minimum interest rates. Banks must reimburse interest.

 

In a judgment of 21st December 2016 (C-154/15, C-307/15 and C-308/15) the European High Court of Justice ruled against the Spanish banks. The court declared that a clause in mortgage contracts which provided for a minimum interest rate, even if the lead rate was significantly lower,wasunlawful. In summary, the repayment claims of the bank customers will amount to a few hundred million euros.  Also in the Balearics many thousands of bank customers will be affected.  Consumer protection associations are assuming thatbecause of the clear legal situation, banks will try to reach out of court settlements.

CONSTANTIN RAHMFELD - Photography - “fiestas on Mallorca” - kings, devils, giants, penitents, and the magic of the fire

 

The Minkner art gallery is holding, for the first time, an exhibition of photographic art work by the young photographic artist, Constantin Rahmfeld. There are two reasons, the first one being, that photography has been recognised as art in the artistic world and the second reason being that Constantin Rahmfeld has worked for Minkner & Partner for the last eight years, and we think that his work should be introduced into a wider circle.

 

Mallorca is the island of “fiestas”! Nearly every local village has its own patron saint and fiestas are held in their honour. On these mystical, bustling and happy occasions, Constantin Rahmfeld loves to capture the special moments with his camera. The photographs for this Exhibition were taken on such occasions, where only the camera and the photographer hold the moment, forever. Whilst looking through the photographs a quote from Friedrich Dürrenmatt comes to mind:“Anyone can take a photograph. Even a machine. But not everyone can observe. Photography is only art when the artist portrays it correctly. Observation is an elementary poetic process. The reality must be formed, to be brought to life.”

Jürgen Wölke - RETROSPECTIVE "assemblages - The world in miniature"

 

The artist Prof. Jürgen Wölke died in 2010. His main body of work was assemblages - patio-plastic material images reflecting what he calls "the world in miniature“. Large-scale works are located, for example, in New York's airport and at Leipzig Central Station as well as in numerous private collections. The Berlin Senate have presented numerous state guests with a Wölke assemblage as a gift.

 

Wölkes most common motives were those of his time battered facades of the German capital, small traditional shops, the Berlin corner pub and scenes from the lives of ordinary people. This work Wölke continued on Mallorca. Again, he found in the capital Palma facades and subjects worth replicating, and he created sensible environmental studies of documentary value. The largest German private collection of Wölke’s work is owned by the bankrupt entrepreneurs Schlecker and was dissolved as a result of the insolvency process.

 

Edith and Lutz Minkner were the main promoters of the artist and part of their Wölke collection is on show in Llucmajor.

Womens Festival “Ella Winter“Mallorca

 

As of 28th December and throughout the following days the “Ella International Lesbian Festival” took place on Mallorca. The Festival’s theme was that of the woman in today’s modern business environment, especially the role of successful, lesbian women in executive positions of employment. 

A press announcement stated “On Friday there will be numerous and diverse events on offer: yoga, meditation, gallery visits, visits to animal shelters, as well as fitness courses on the beach“ – are these the correct themes for the modern business woman? Maybe for next year we could suggest some other seminar models: “Knitting without fear” or “Baking without flour!!!!!! “

We too shall take a short Christmas break. The next issue of our newsletter will be published on the 13th of January and then as usual every second Friday. We are pleased to announce that in 2017 it will be the 10th anniversary of our M & P newsletter.

 

Minkner & Partner will be opening its new frontline office in Pto. Andratx at the turn of the year

 

Whilst you are reading this newsletter, the workmen are putting the finishing touches to the new office premises of Minkner & Partner in Puerto Andratx. The removal men are already loading and unloading all of the office furniture. At the turn of the year 2016/ 2017 our new frontline premises, located opposite the fish market ‘La Lonja’, in Avenida Mateo Bosch 11, will be opening its doors. The office telephone number will stay the same +34 971 671 250. The multi-lingual team has been increased, and under the management of sales director Matthias Neumann, have been in training for the past few weeks and look forward to new, exciting business challenges. Our grand opening will be held on the 24th of February 2017.

 

Mallorca’s Properties: Price increases for existing properties in the third quarter of 2016 of 6.1 %

 

The Spanish Institute of Statistics (INE) has published its latest figures for property prices in Spain. The statistics show that real estate prices in the Balearics rose by 5.4 % in the third quarter of 2016 compared to the same period of the previous year. In Spain, the price increase was an average of 4 %. For new developments, the price increase on the Balearic Islands was slightly more moderate with 3.4 %, whereas in the case of existing real estate it was 6.1 %. Since new build activity has not yet reverted to pre-crisis times, many purchasers have had to resort to existing housing, which influences the prices.

 

2. Mallorca – Construction, Economy laws and taxes

 

(1) Construction / Investment

 

Palma: Facades of buildings are placed under conservation order against advertising

 

Palma is having a spring clean and the façades of the old town are now impeccable. However, according to ARCA, the Monument Conservation Association, this is not the case throughout Palma. All over the city business premises have opened on the ground floor of old town houses and their advertising covers the historical façades. ARCA point out that all buildings in the historical old town of Palma come under conservation order and that no advertising or painting of the façades should be permitted. Only those changes which would not affect the overall appearance of the old town are likely to be approved.

 

Palma: City Palace “Can Bordoy“ is going to be converted into a Boutique - Hotel

 

In Palma’s old town a new boutique hotel is to open. The award-winning architects, Paloma Hernaiz and Jamie Oliver (OHLAB) are commissioned to convert the city palace into a boutique hotel. Originally the plan was to convert the city palace into apartments; the palace comprises a construction area of 1.000 m², as well as a courtyard and a beautiful garden. The hotel will have a restaurant that will also cater for the general public as well as hotel guests.

 

Palma: Parliament is in agreement with the expansion of the Port of El Molinar

 

For several years now, there have been discussions regarding the development of the Es Molinar port: Advocates of the expansion plan want to increase the number of moorings from 72 to 220 and the total area of the harbour to 72,000 m². On the other hand, residents and environmentalists have fiercely protested against this proposal and have received the support of the current left-wing government. The Balearic Parliament with its left-wing majority has now voted against the project, but wants to discuss and examine alternative solutions with the Spanish Construction Ministry and the Port Authority.

 

Cala Ratjada: The harbour is going to be reconstructed at a cost of 7, 6 million Euros

 

The port of Cala Ratjada is to be redeveloped and renovated with funds from the state government to the amount of 7.6 million euros and thereby the state government is fulfilling a long-standing demand from the local authorities, who had repeatedly pointed out safety shortcomings. The funds are mainly being used for the redevelopment of the port's protective dam which was expanded 50 years ago, and is leaking. As a result of this leakage, when there are high waves there is considerable danger to residents, tourists, fishermen and the local boatbuilding industry. Furthermore, the moorings are to be re-arranged and expanded. The required tenders for the project will begin in January 2017.

 

Capdepera: 2017 will see the beginning of the construction of the long planned coastal cycling path

 

For many years now the project for the coastal cycling path has been put on hold by the town hall of Capdepera. Now the necessary funds for the planning phase have been made available in the 2017 budget. The total cost will be approximately 6 million euros. The cycle path will connect the villages of Cala Ratjada, Cala Mesquida, Cala Agulla, Cala Lliteras-els-Pelats, Cala Gat, Son Moll, Pedruscada-n'Aguait-es Carregador, Font de sa Cala- Provencals and Canyamel.

 

Deia: Deia’s local authorities are planning a salt water desalination plant

 

In view of the water problems last summer, Deia’s local authorities are planning to build a sea water desalination plant. The estimated cost for this project is 1 million euros.It is intended that the revenue from the tax Ecotasa (environmental tax, tourist tax) will fund this project.

 

Meanwhile, Mallorca’s reservoirs are gradually recovering. Due to the rainfall of recent weeks, the water level is currently around 40 %, higher than in the previous year.

 

The island council is investing 30 million in Infrastructure projects

 

In the coming year, the island council will be investing 30 million euros in infrastructure. This entails a total of 244 different projects which are due to be implemented in 2017. They will focus on refurbishing buildings with a total of 47 projects, as well as the construction of roads and motorways amounting to some 56 projects, and also the elimination of hazards on streets for disabled people with a further 15 projects. Also planned are 70 energy efficiency projects and 56 water projects. In addition to the meaningfulness of these projects, the "investment of historical dimensions" will also serve to stimulate the economy.

 

(2)Economy

 

Forecast for economic growth: In 2016 = 4, 1 %, 2017 3,7 %

 

The Balearics are likely to be European champions in 2016 with regard to economic growth. The Ministry of Labour and Industry has drawn up a provisional balance sheet for 2016 and announced an economic growth rate of 4,1 % in 2016. An economic growth of 3,7 % is predicted for the Balearic Islands in 2017. Even though this is only a forecast the left Labour Minister Iago Negueruela is already thinking of how he will use it: There must be a better distribution of wealth from top to bottom. Employees should demand higher salaries. Moreover, the labour market reform carried out by the conservative central government should also be withdrawn.

 

Agricultural minister of the Balearics: Due to the economical dry period, rough losses had been made

 

In 2016 the Balearic Islands' agricultural industry was hit by heavy losses. Sales went down by half, according to the farming Association ASAJA. The olive, almond and cereal crops were particularly hard hit. For some farmers, the yield is practically zero in October and November due to the long drought and low rainfall. The Balearic Government had granted the farmers concerned tax reliefs but these are merely “a drop in the ocean".

 

Shadow economy and black money: Cash transactions between business people should be no higher than € 1.000 effective as of 1st January 2017

 

The central government is working on a draft bill, whereby as of January, 1st 2017, cash transactions among businessmen will only be allowed up to the amount of € 1,000. Up until now the limit was € 2,500. This is seen as a further step in the fight against the shadow economy and violations will be punished with severe penalties. With regards to the € 1,000 limit, only payments between private individuals or non-residents are excluded.

 

Tourism I: Foreign Tourism spent from January to October 2016 12,7 million euros on the Balearics

 

Never before in the history of tourism has the Balearics had so many visitors as this year and this means that cash registers were ringing. During the period from January to October 2016 12,7 million euros were spent in the Balearics. This is 10.5 % more than the previous year. Throughout Spain only Cataluña can quote better figures. The "average tourist" stayed seven days and spent € 1,023.

 

Tourism II: Goodbye Air Berlin

 

After almost 40 years of successful business in the tourism industry, as of summer, 2017 Air Berlin will cease operating its flights to and from Mallorca. Very sad, as Air Berlin played a large part in the success in Mallorca’s tourism. The winter flight plan as well as tickets already booked, maintain their validity. Flights to and from Mallorca will be operated by an airline which will combine Niki and Tuifly. However, the negotiations between Tui and Etihad, the major shareholder of Air Berlin, have not yet been completed. Air Berlin has already transferred its Niki shares to Etihad. The new airline is expected to have 60 aircrafts, which are to be used mainly for flights to Mallorca and the Canaries. The new company will be based in Vienna.

 

Tourism III: Germania new subsidiary in Mallorca

 

As Air Berlin is ceasing its operations and handing them over to Niki, other companies are interested in taking over the market such as Germania, who is expanding and is going to have a base here in Mallorca as of May 2017. Due to a great demand of flights to Mallorca from Germany and Switzerland, Germania has seen a gap in the market and for this reason they will be flying on a daily basis to and from Friedrichshafen, Dresden, Bremen, Münster/ Osnabrück, Zürich, Nurnberg, Erfurt, Rostock und Dortmund. Further destinations will also be included such as: Maastricht, Montpellier and Strasbourg.

 

(3) The law taxes and finance

 

The left-wing government is intervening illegally against nature conservation

 

The left-wing government is environmentally and nature-friendly. It does not, however, act according to its declared election goals. Latest example: About 3 % of the world heritage Serra de Tramuntana is under special protection. People are not allowed to enter in this area because rare animal species such as the monk vulture and the midwife toad are not to be put at risk. This 3 % are "zonas de exclusion” and are located mainly in the north of the island. Some interested persons have already tried several times to modify this protection. In 2015 the courts upheld this protection order. Now the left-wing government - the environmentalists - in an “about turn" – wish to introduce an amendment to the law that allows access to these protected areas. The Ministry of Finance and Public Administration in Madrid have said that the new law of the Balearic Islands is not only a violation of the law to protect these areas, but also a violation of the constitution. The disputed law is now to become the subject of a mediation commission between the central and Balearic governments and, if necessary, conceded.

In times of empty coffers, Mallorca’s building authorities have employed more staff and are better organized in order to hand out the necessary punishments for building violations. Anyone who builds without permission has a higher risk of being caught and punished. The owner of an agricultural plot alongside the motorway close to Arenal has suffered the consequences! He built a small 25 m² house with a pool which he planned to extend by a further 130 m² He had been refused permission in 2009, however, he disregarded this decision and carried on building. In 2013 he received instructions to demolish the house and pool and to restore it to its original state. He also received a penalty payment of € 112.000, which has been upheld in the appeal court.

CONSTANTIN RAHMFELD - Photography - “fiestas on Mallorca” - kings, devils, giants, penitents, and the magic of the fire

 

The Minkner art gallery is holding, for the first time, an exhibition of photographic art work by the young photographic artist, Constantin Rahmfeld. There are two reasons, the first one being, that photography has been recognised as art in the artistic world and the second reason being that Constantin Rahmfeld has worked for Minkner & Partner for the last eight years, and we think that his work should be introduced into a wider circle.

 

Mallorca is the island of “fiestas”! Nearly every local village has its own patron saint and fiestas are held in their honour. On these mystical, bustling and happy occasions, Constantin Rahmfeld loves to capture the special moments with his camera. The photographs for this Exhibition were taken on such occasions, where only the camera and the photographer hold the moment, forever. Whilst looking through the photographs a quote from Friedrich Dürrenmatt comes to mind:

“Anyone can take a photograph. Even a machine. But not everyone can observe. Photography is only art when the artist portrays it correctly. Observation is an elementary poetic process. The reality must be formed, to be brought to life.”

ELENA GATTI and Peter Thoms - from graphic to abstract

 

One aspect of the history of painting of the 20th century is the shift from figurative representation through several development steps to a gradual abstraction whose ultimate goal was the complete disintegration of the graphic. The result is an autonomous artistic statement. The Minkner Art Gallery in Santa Ponsa offers a new collective exhibition by the artists Elena Gatti and Peter Thoms, who follow the path from graphic to abstract through their work.

 

Elena Gatti was born in 1950 in Argentina, and now lives and works in her adopted home of Mallorca. By sketchy allusions and overwriting them to evolve forms, light and shadow, and thus comes to new perspectives of objects and people. It stimulates the imagination of the viewer, creating "works for immersion".

 

Peter Thoms, awarded the Ruhr Prize for Art and Science, is a master of the game of colour and light, which he uses almost playfully to resolve the representational and abstract. From the Middle distance, itself developed from the ordered chaos arises.

Jürgen Wölke - RETROSPECTIVE "assemblages - The world in miniature"

 

The artist Prof. Jürgen Wölke died in 2010. His main body of work was assemblages - patio-plastic material images reflecting what he calls "the world in miniature“. Large-scale works are located, for example, in New York's airport and at Leipzig Central Station as well as in numerous private collections. The Berlin Senate have presented numerous state guests with a Wölke assemblage as a gift.

 

Wölkes most common motives were those of his time battered facades of the German capital, small traditional shops, the Berlin corner pub and scenes from the lives of ordinary people. This work Wölke continued on Mallorca. Again, he found in the capital Palma facades and subjects worth replicating, and he created sensible environmental studies of documentary value. The largest German private collection of Wölke’s work is owned by the bankrupt entrepreneurs Schlecker and was dissolved as a result of the insolvency process.

 

Edith and Lutz Minkner were the main promoters of the artist and part of their Wölke collection is on show in Llucmajor.

(1) Construction / Investment

 

Palma – El Terreno: Two construction projects are being carried out in 2017

 

El Terreno was one of the most sought after residential areas of Palma. Today the area is very run down:Many of the buildings are empty, only bars one next to the other and at night the area is very noisy and unsafe. Therefore, the time has come for Palma’s City council to reinvest. Two projects are planned for 2017: First of all, the Torrent del Mar Pas that runs from the small fishing harbour of Can Barbara to the Bellver Castle where they plan to create a park where you can enjoy walks as well as spend leisure time. The second project is the restoration of the swimming pool S´Aigua Dolca, which opened in 1941 and was open until the 70s. Tenders are being submitted for both projects.

 

Palma: Gesa – Empty building under conservation protection

 

The emblematic glass facade building of the Gesa Electricity Company located on the outskirts of Palma city, has stood empty for the last 15 years since Gesa moved out. Some wanted to knock down the building others wanted to have it protected under conservation laws. The conservationists won the day in 2007 as the Mallorca council put the building under conservation protection. This decision was decided, eventually, through many court procedures. Until now the building is under the conservation laws just an empty building. Ideas on how to use the building are under discussion, but so far nothing has been confirmed. The council have suggested that it could be used for cultural purposes. Without any particular concept, it has been decided to spruce up the ground floor at a cost of 15.000 €. For 2017 it is planned to invest a further 200.000 €. For what? A fiasco both politically and planning wise.

 

Calvia- Magaluf: 45 Million - Calvia Beach Resort Project construction work has begun

 

In the last days, the extensive construction work on the new Calvia Beach Resort has started. The Melia group and its partners have planto build a new 4-star hotel in which they will invest 45 million euros in. The hotel will comprise 270 rooms, various pools and terraces, restaurants as well as a shopping mall, leisure areas and gyms. The offers are to be "challenging" in the sense that they are striving to change Magaluf from a British party mile to the higher-end family holiday resort. The opening of the new hotel is planned for 2018 and 260 new jobs are to be created.

 

(2)Economy

 

Tourism I: The Golf tourism brings an annual revenue of 220 Million Euros to the Island

 

The International Golf Market (IGTM) took place on Mallorca from 14th to 17th November; it is the most important branch of golf tourism in Europe. 450 exhibitors from 55 countries and more than 100 sports journalists participated in the event. Although, the current left-wing government is highly critical of golf and is trying to prevent the construction of new golf courses whenever possible, they do welcome this event and its glamourous international guests. They are also pleased to claim the economic contribution of the golfers to the tourism business as their success. Every year, the golfers spend 220 million euros on the islands, which is relied on by the Ministry of Tourism.

 

Tourism II: Germania Airlines are opening a new subsidiary here in Palma

 

Due to the ‘turbulence’ that Air Berlin is suffering, the airline Germania plans to open a new base in Mallorca for the summer of 2017. First, a Boeing 737-700 is to be stationed at the Son Sant Joan airfield following which, 65 weekly flights to Germany and Switzerland will be available for booking. Further destinations planned are Holland and France. The airline Germania has been well-established for over 30 years in Berlin, and carries 2.8 million passengers annually.

 

Tourism III: Mallorquin Airline “Air Europa” goes USA

 

The highly successful Mallorquin entrepreneur “Hidalgo” is planning an international expansion with his airline Air Europa, which is based in Llucmajor. They will be expanding internationally and have targeted the US. As from the summer of next year, Air Europa will fly from Madrid to Boston on Wednesdays, Fridays and Sundays. In addition, there will be 20 other destinations in North and South America on their programme.

 

Tourism IV: Mallorca’s hotels reported 70 % occupancy in the month of October

 

 “Golden October"- also for Mallorca’s hotel industry, almost 800 hotels were open with 70 % occupancy. In addition to the absence of other holiday destinations, the hoteliers see the reasons for the extended season mainly in the investment they have made in the hotels. Spacious SPA areas and other similar amenities prompt the guests to travel to Mallorca even when the high temperatures are gone. In the coming winter season, Mallorca’s hoteliers want to invest a further 300 million euros in their hotels in order to improve the offer.

 

Gastronomic: Michelin awards Michelin stars to two restaurants in Mallorca

 

 The suspense is over; Michelin awards its stars for the new Michelin guide. Two more restaurants enter the elite Michelin circle. One of which is the restaurant “Agos” in Port de Pollenca with Chef Alvaro Salazar and the other restaurant “Quetglas” in Palma, with chef and owner Adrian Quetglas. The other restaurants with a star in Mallorca are: Simply Fosh in Palma, the restaurant of Andreu Genestra in Capdepera, the Es Moli d`en Bou in Sa Coma, the Raco de Teix in Deia, the Jardin in Alcudia and the Es Fum in the Hotel Mardavall in Portals Nous. The top chef of the Michelin Stars is Fernando Perez Arello from the “Zaranda” at the Hotel Son Claret in Es Capdella.

 

(3) The law taxes and finance

 

The Spanish S.L. -An investment model when buying a family home will soon be discontinued

 

Until 2007, the Spanish limited company was an interesting option when acquiring a Spanish property. The main reasons being taxes: if instead of the property the company's shares were sold (share deal), no real estate transfer tax was levied, if the property was sold by the company, the company paid only 15 % corporate tax on the profit, while the non-resident private owner of a property paid 35 % tax on profits. In the meantime, the legislators have put a stop to both "tricks": In the sale of shareholdings of companies now the property transaction tax is paid and corporate tax on the profits of the sale of the company's property amounts to 25 %, while non-resident owners have to pay only 19 %. For these reasons the model S.L. is a thing of the past.

 

However, many property owners did not use the possibility of transferring the property to private property, keeping the property under the regime of S.L. and rented the property at a reasonable price (otherwise it would be a taxable and hidden benefit). This fiscal model is also close to its end: the German Federal Court of Finance has recently ruled in three judgments that the private use of the property is not taxed as a rental value "usual in the market" but rather requires that the SL and users will agree and pay the higher costs. Council: Liquidate immediately the S.L. Ask your Tax Advisor (BFH I R 8/15; I R 12/15 and IR 71/15 Judgments).

 

Planned property law threatens banks and property developers with penalties for empty resident housing

 

The socialist Balearic government wants to intervene in the housing crisis, particularly in and around Palma by taking drastic measures.It threatens real estate developers and banks with interventions similar to the expropriation of homes that have been vacant for more than two years: if the flats are vacant more than two years, they must be "assigned" to the government of the Autonomous Community. The corresponding ministry is allowed to rent the apartments at social rent levels for three years. In this way, "people who are looking for flats will have the opportunity of a dignified life". Builders and banks have to inform the government of their vacant housing. Penalties for infractions of this requirement may amount to € 30,000. Availability will be checked with the help of companies that supply gas, electricity and water or with reading consumption in apartments. The bill also provides that banks cannot evict defaulting borrowers but will have to offer them leases. It can be assumed that the bill will be revised in reference to its constitutionality because here the constitutional rights of the protection of property and the guarantee of the social state collide.

 

Ignorantia legis excusat! Ignorance does not protect you from punishment – “Maybe sometimes”

The Spanish courts

 

It is an old principle from Roman law that ignorance does not protect against punishment (Ignorantia legis non excusat), that is, an accused cannot rely on the fact that he did not know the corresponding legal regulations. In other words, every citizen is obliged to know what is permitted and what is not. The object of this type of error is a large field for criminal lawyers. A German real estate owner sold his villa with a large profit, but only declared 3 % of the final price of the sale in his account A. He had good lawyers (de la Mata and Buades) and luck: although the prosecutor's office asked for a two-and-a-half-year sentence of imprisonment, the accused was acquitted of tax evasion. The court had doubts as to whether the accused acted intentionally. It is not to be refuted that he acted in good faith and thought that the payment of 3 % his tax liability was covered. The notary agreement had only been read in Spanish, which the participants did no thoroughly understand, and everything happened very quickly. A lucky decision for the accused.

 

City of Palma presents the budget for the year of 2017

 

After long internal discussions, the city of Palma has now presented its budget draft for the year 2017. Nearly 412 million euros are to be made available for municipal expenditure in the coming year. It is the highest budget since 2011, and it is 6 % above the spending of the current year. Emphasis of the budget is on social projects, employment schemes for young people and investments in health care. Savings relate primarily to public services.

„Golf con Corazon“ – Sponsor Minkner& Partner – raises 44.000 Euros for children suffering from cancer

 

Since the beginning of the year the charity organisation ASPANOB (a charity which supports parents of children with cancer) has held a series of golf tournaments known as “Golf con Corazon”.   Minkner & Partner is one of the main sponsors for this charity, and 300 people took part in this event on various golf courses such as  Alacanda, Son Antem, Camp de Mar, Son Gual, Puntiro, Maioris as well as Poniente.  This year 44.000 Euros were raised, and donated to the charity ASPANOB. Many thanks to all participants and sponsors

 

2. Mallorca – Construction, Economy laws and taxes

 

(1) Construction / Investment

 

Palma: Es Jonquet windmill owners must restore them

 

The ruins of the windmill in Es Jonquet above the harbour promenade of Palma have been an eyesore for decades. The city council is now urging the owners of the listed windmills to restore them. Previously, the city council had modified the development plan and allowed the use of the mills and the annexes for residential purposes, as the owners had intended, but as of yet nothing has happened. The municipal authorities have now advised the owners that according to the Act on the Protection of Historical Buildings they are obliged to keep the listed buildings in perfect condition. Expropriation was also discussed however the city council lacks funds for the necessary compensation.

 

Andratx  - Sant Elm/San Telmo: Coastal town gets second exit

 

In the charming fishing village of Sant Elm, on the southwest cost of Mallorca, roadworks are underway. These works are taking place along the Cami de Sa Font dels Morers in order to create a second exit. Until now, the small coastal town has only been accessible by means of a winding mountain road, which has only one lane for traffic in both directions. This leads to congestion especially in the summer season. With the restoration of the Cami de Sa Font dels Morers there will be a second exit, which will make the traffic flow much better.  Andratx council, to which Sant Elm belongs, have announced that a further seven roads will be repaired and resurfaced.

 

(2) Economy

 

Tourism I: Airport reports passenger record for the month of October

 

Once again for the month of October 2016, Palma’s airport has announced a new passenger record. This month, there were 2,773,585 passengers, which is 17% more than in the same month of the previous year. The figures for the period from January to October 2016 are also definitive: during this period, 24.7 million passengers arrived to or departed from Son Sant Joan which is an increase of 11% in comparison to 2015.

 

Tourism II: Good prospects for 2017 following the World Travel Market Exhibition

 

Travelling educates! A large delegation, headed by Francina Armengol President of the Balearic government, director general for tourism Pilar Carbonell, tourism minister Biel Barceló and Director ATB Munoz, visited the World Travel Market in London. Despite Brexit, in 2017 there is an expected growth in tourism of 20% from the UK. At the same time the Melia Group presented the Congress Palace, as they are the new tenants. In the first five-year plan up to 2021, it is expected there will be 320 congresses/seminars and 77,000 participants. Congresses (Seminars) are already planned as far ahead as 2020.

 

Tourism III Palmas harbour is expecting for 2017 an increase in passengers of 15,89%

 

After a record year 2016, Palma's port expects a further increase in passenger volume of 15.89% for 2017. This was announced by the Port Authority after the major cruise companies such as AIDA, Costa, MSC and Thomson have notified their plans for 2017 and have booked berths accordingly. In 2016, there were 555,620 passengers who checked in and out of Palma, there will be 643.918 in 2017. The passengers checking in and out are particularly interesting for Palma's tourism industry, as they often extend their holidays for a few days and book hotels in Mallorca and therefore also spend more money.

 

Tourism IV: From 2018 onwards, cruise ships also will be docking in area of Cala Ratjada

 

Cruise ship tourism brings a lot of money to the island. However, voices are getting louder and louder, calling for a reduction in the number of ships that sail on the same day to Palma's port. The mayor of Cala Ratjada, the Port Authority and the Balearic Government are working on a plan so that cruise ships will also dock in the bay of Cala Ratjada from 2018 onwards - not in the harbour, but on a buoy. In anticipation of the new flow of tourists, Cala Ratjada’s town council is developing plans to expand the shopping and gastronomic offer and two new hotel or extensions to existing buildings are also being discussed.

 

Fan Mallorca Shopping: opening of cinema complex with eight cinemas

 

Mallorca's new shopping centre FAN MALLORCA SHOPPING, opens a new attraction: a cinema complex with eight cinemas and 1,200 seats. The cinemas feature state-of-the-art technology with a 4-D experience, laser projectors and Dolby Atmo sound systems. The programme can be found on the website of www.artesiete.org.

 

25th of November 2016 – Discount battle “ Black Friday” in Palma

 

On "Black Friday" – a discount battle between retailers - the Christmas shopping begins in the USA. It takes place on the Friday after Thanksgiving and was first held in Philadelphia in 1966. Over the last few years, Palma’s stores have also adopted this custom. They advertise huge price reductions and want to open their shops until 23.00h. Many retailers want to continue the Black Friday until the Sunday sales (27th of November). Many online shops also participate in the campaign. Palma's city administration wants to turn on the Christmas lights on Black Friday. The left-wingers of the city administration, who do not have much to do with the economy, have now moved the switching on of the Christmas lights to 2nd December.  So, in reality, Black Friday

 

(3) The law taxes and finance

 

The tax authorities are asking owners of rental properties who are not paying taxes, to pay up

 

Many owners of apartments and houses rent out their properties on a regular basis to holidaymakers, without registering and without paying tax on their income. The review by the Spanish financial authorities was in the past rather superficial. In addition, the legal situation regarding the legality of the holiday rental was very different. Since the entry into force of the Tourism Tax Act this year, the owners of rented apartments and houses are obliged not only to pay income tax on the rental income, but also to collect the tourism tax from the tenants. Due to the non-payment of these two taxes the state loses a considerable amount of money, and so the financial authorities have dug deeper and have approached numerous landlords and requested information. 60% of the mentioned landlords have now made further explanations and thus avoided the imposition of a drastic monetary fine. Apart from the internet and other publications, the financial authorities were given the most clues as to "black landlords" by dear neighbours.

CONSTANTIN RAHMFELD - Photography - “fiestas on Mallorca” - kings, devils, giants, penitents, and the magic of the fire

 

The Minkner art gallery is holding, for the first time, an exhibition of photographic art work by the young photographic artist, Constantin Rahmfeld. There are two reasons, the first one being, that photography has been recognised as art in the artistic world and the second reason being that Constantin Rahmfeld has worked for Minkner & Partner for the last eight years, and we think that his work should be introduced into a wider circle.

 

Mallorca is the island of “fiestas”! Nearly every local village has its own patron saint and fiestas are held in their honour. On these mystical, bustling and happy occasions, Constantin Rahmfeld loves to capture the special moments with his camera. The photographs for this Exhibition were taken on such occasions, where only the camera and the photographer hold the moment, forever. Whilst looking through the photographs a quote from Friedrich Dürrenmatt comes to mind:

“Anyone can take a photograph. Even a machine. But not everyone can observe. Photography is only art when the artist portrays it correctly. Observation is an elementary poetic process. The reality must be formed, to be brought to life.”

ELENA GATTI and Peter Thoms - from graphic to abstract

 

One aspect of the history of painting of the 20th century is the shift from figurative representation through several development steps to a gradual abstraction whose ultimate goal was the complete disintegration of the graphic. The result is an autonomous artistic statement. The Minkner Art Gallery in Santa Ponsa offers a new collective exhibition by the artists Elena Gatti and Peter Thoms, who follow the path from graphic to abstract through their work.

 

Elena Gatti was born in 1950 in Argentina, and now lives and works in her adopted home of Mallorca. By sketchy allusions and overwriting them to evolve forms, light and shadow, and thus comes to new perspectives of objects and people. It stimulates the imagination of the viewer, creating "works for immersion".

 

Peter Thoms, awarded the Ruhr Prize for Art and Science, is a master of the game of colour and light, which he uses almost playfully to resolve the representational and abstract. From the Middle distance itself developed from the ordered chaos arises.

Jürgen Wölke - RETROSPECTIVE "assemblages - The world in miniature"

 

The artist Prof. Jürgen Wölke died in 2010. His main body of work was assemblages - patio-plastic material images reflecting what he calls "the world in miniature“. Large-scale works are located, for example, in New York's airport and at Leipzig Central Station as well as in numerous private collections. The Berlin Senate have presented numerous state guests with a Wölke assemblage as a gift.

 

Wölkes most common motives were those of his time battered facades of the German capital, small traditional shops, the Berlin corner pub and scenes from the lives of ordinary people. This work Wölke continued on Mallorca. Again, he found in the capital Palma facades and subjects worth replicating, and he created sensible environmental studies of documentary value. The largest German private collection of Wölke’s work is owned by the bankrupt entrepreneurs Schlecker and was dissolved as a result of the insolvency process.

 

Edith and Lutz Minkner were the main promoters of the artist and part of their Wölke collection is on show in Llucmajor.

1. News from Minkner & Partner

 

Minkner & Partner – Office Pto. Andratx – New Opening on the 19th of December 2016

 

As already announced, Minkner & Partner will be expanding at the turn of the year in Pto. Andratx and taking over new, larger business premises. The new premises are located directly on the harbour promenade opposite the fish market in Avda. Mateo Bosch No. 8, Local 2 (previously business premises of lawyer and broker Gaspar Alemany Ferrer). The reconstruction work is in full swing and the move to the new premises will take place on the weekend from 16th - 18th December 2016. With the acquisition of the new premises Minkner & Partner will have top quality, additional experienced staff in their new offices who will be preparing for their new tasks in the run up to the opening of the new Pto. Andratx office. In addition, international media and an extensive marketing campaign will introduce the new location in Pto. Andratx to the public. After a soft, low key opening, a grand inauguration will take place on 24th February 2017. In addition, a special issue of the Minkner & Partner magazine MALLORCAS TRAUMIMMOBILIEN will be published (also as a supplement to the edition of the Mallorca magazine), which will be published on the same day.  This will be exclusively related to the real estate market of Pto. Andratx and Camp de Mar.

 

2. Mallorca – Construction, Economy laws and taxes

 

(1) Construction / Investment

 

Palma: AENA invests a 100 million in Son San Joans Airport

 

The operating company of the Son Sant Joan airport will invest 100 million euros in the construction of the airport next year. A free short-term parking space is to be constructed in the arrival area of Palma’s airport. The approximately 80 parking spaces are expected to be available this coming spring. In addition, so-called family rooms will be built in which families with children can spend time whilst waiting for their flight. The airport will also provide facilities to re-charge all electronic devices. A huge project is the renewal of the asphalt for the southern runway.

 

Palma: Congress Palace – Four Star plus hotel “Melia Palma Bay”

 

Guests of the new hotel "Melia Palma-Bay “will access the Congress Palace via a bridge. The hotel has 268 rooms and suites, a large spa area and a rooftop pool. It will be run as a 4 Star plus hotel, although it offers the standard of a 5 Star hotel. As Gabriel Escarrer reported, many companies who hold seminars, have an ethical code not to use 5 star accommodation, therefore they go one lower and use a 4 star or 4 star plus.

 

Palma: Provisional off for Son Averso golf course near Palma

 

For the past eight years, the Son Averso golf course has been in the planning at the entrance of Palma. A golf course with 30 holes, training facilities and a 5-star hotel are planned. The Balearic Islands Environmental Commissioners has now voted against the approval of the planning. The project is "unreasonable „and as this is one of the most important natural areas in Palma area.

 

Pto. Soller: "Completely in White" - planning for new port buildings was presented

 

The construction work is scheduled to start in the autumn of 2017; the new port buildings in Pto. Soller should be completed. The design of the flat buildings with horizontal lines, which was now presented, is by the architect Alberto Martin. It dominates the colour white; the materials are glass, concrete and sandstone. A 300 m² building is reserved for fishermen and fishermen. The storage area, cooling area as well as sales offices and a area for freshly caught fish as well as dressing rooms. In a separate area, the fishermen can repair their nets and dry them. A total of 67 parking spaces are being built. Three further buildings are planned for administration of the port, a diving school, a restaurant and a bar. The built-up area will be 1,200 m². The total investment is stated at 4.5 million euros.

 

 

Santa Ponsa: The tourist resort Santa Ponsa is building a seafront promenade

 

Calvias local town hall is planning to build a new seafront promenade from the restaurant “The President” up to the Santa Ponsa boat berths.  The second phase of construction will be continue on to Es Castellot, along the east coast of Santa Ponsa´s bay.  With the expansion of the beach’s promenade the previous access difficulties to the bay will no longer exist, making this route more accessible in the future for tourists as well as residents.

 

Cala Millor: Improvements for the seaside harbour town of Cala Millor

 

Cala Millor wants to change its image for the next summer season. The administration of the local community of Son Severa will be investing €630.000. The budget also includes the renewal of the main roads in the town which includes the  Avenida Joan Servera Camps.  New trees will be planted and the streetlights renewed. In the Carrer Rafalet, a new road surface is to be laid and potholes removed. Finally, the coastal promenade between the streets of Pula and Sipells will be improved.   

 

Hotels: an additional 300 million euros will be invested in modernization

 

Nearly 700 million euros have been invested by Mallorca's hoteliers in the modernisation and complete refurbishment of their hotels over the last four years. During the next 6 months (winter) a further 300 million euros will be invested, so that the total investment will be just fewer than one billion euros. The basis for this investment was a law passed by Tourism Minister Delgado, which allowed hoteliers to increase their businesses in connection with modernisation measures. Similar investments are not to be expected in the future, as the current left-wing government has significantly restricted the possibility of an increase in the number of hotels. In 2 ½ years elections will be taking place.

 

(2) Economy

 

Tourism I: Mallorcan winter flights 2016/2017 - 36,000 flights with  5.6 million offers

 

The 2016/2017 winter timetable for the period from 30th October 2016 up to 25th March 2017 also sets a new record: It offers 36,000 flights for Mallorca’s guests with seats for 5.6 million passengers. With respect to the number of flights, this is an increase of 5.1% compared to the previous year, and the number of seats shows an increase of 3.3%. 115 different destinations are targeted. The preferred countries are domestic flights to Germany and the UK

 

Tourism II: Foreign investors are increasingly buying hotels in Mallorca

 

The newspaper Ultima Hora reports that foreign investors have already invested 260 million euros for the purchase of hotels on the Balearic Islands in the first half of the year. This is nearly twice as much as last year and in previous years. Investors are predominantly tour operators and tourism companies who want to place their customers in their own properties, where they can determine the price policy themselves. Of the total investment sum, 142.6 million euros are attributable to investors from Germany , such as Alltours, TUI and Thomas Cook.

 

Tourism III: Hoteliers are highly satisfied with their occupancy capacity in September

 

 September 2016 was highly gratifying for Mallorca’s hoteliers. Both the occupancy of their hotels and the income per bed / night are much higher than the Spanish average, according to the official Spanish statistics institute. In September 2016 Mallorca was able to welcome around 1 million tourists, which led to a utilization rate of 92%.  On average the price for one night is € 95 per room (price increase to the comparable month of the previous year of 9%), which means that Mallorca took the leading position.

 

Unemployment rate:  10% unemployed in the Balearic Islands

 

The unemployment rate in the Balearic Islands has fallen. In the third quarter of 2016, the average unemployment rate fell to 10.6%, making it the lowest in Spain. In Spain, the average unemployment rate is currently 18.9%. In the Balearic Islands, this means that currently 67,900 people are registered as unemployed, which is 14,100 less than in the previous quarter. These figures have now been announced by the Spanish Institute of Statistics (INE)

 

Congress Palace: Congress Palace and Hotel to be opened by March 2017; 200 new jobs are created

 

The Melia hotel group has been awarded a contract for the running of the Congress Palace on the outskirts of Palma and its affiliated hotel. One of the conditions of the award is that the hotel should be fully operational as early as March 2017. Melia are in the middle of the preparations and have already taken bookings for the coming year. As the Melia Hotel group reported, 200 new jobs will be created with the commissioning of the complex.

 

Solar Park in the municipality of Manacor is to be developed in a lesser form

 

German investors, who leased the estate of Santa Cirga with the purpose of creating a solar park, presented the first draft to build the park in a reduced form because of the protests. This month, the modified project should open to public inspection and then await approval from the state government. The operator Cirga Santa Photovoltaic Park S.L. belongs to the German company KS Management Investor. Unlike the original plan, the new plan uses only 56 hectares instead of the original 90 hectares. The number of modules has been reduced from 250,000 to 190,000.

 

(3) The law taxes and finance

 

Property tax: Who owes the local rates when selling a property?

 

A frequent bone of contention when purchasing a property has always been the question of who is responsible for paying the rates for the current year, if the house is sold in the middle of the year. This is based on Spanish law according to which the person who is owner of the property on the 1st January of the current year is liable to pay the costs. Minkner & Partner had always solved this issue in the past in such a way that both parties agreed in the purchase contract that they have to pay the local rates pro rata for the property in the current calendar year. This legal practice has now been confirmed by the Supreme Court of Spain by a judgment of 15 June 2016:  if on the 1st January of the current year the seller has paid the rates he may request the pro rata refund from the buyer. Only if the parties expressly exclude the application for reimbursement in the purchase contract, the claim no longer applies.

There are two reasons, the first one being, that photography has been recognised as art in the artistic world and the second reason being that Constantin Rahmfeld has worked for Minkner & Partner for the last eight years, and we think that his work should be introduced into a wider circle.

 

Mallorca is the island of “fiestas”! Nearly every local village has its own patron saint and fiestas are held in their honour. On these mystical, bustling and happy occasions, Constantin Rahmfeld loves to capture the special moments with his camera. The photographs for this Exhibition were taken on such occasions, where only the camera and the photographer hold the moment, forever. Whilst looking through the photographs a quote from Friedrich Dürrenmatt comes to mind:

“Anyone can take a photograph. Even a machine. But not everyone can observe. Photography is only art when the artist portrays it correctly. Observation is an elementary poetic process. The reality must be formed, to be brought to life.”

ELENA GATTI and Peter Thoms - from graphic to abstract

 

One aspect of the history of painting of the 20th century is the shift from figurative representation through several development steps to a gradual abstraction whose ultimate goal was the complete disintegration of the graphic. The result is an autonomous artistic statement. The Minkner Art Gallery in Santa Ponsa offers a new collective exhibition by the artists Elena Gatti and Peter Thoms, who follow the path from graphic to abstract through their work.

 

Elena Gatti was born in 1950 in Argentina, and now lives and works in her adopted home of Mallorca. By sketchy allusions and overwriting them to evolve forms, light and shadow, and thus comes to new perspectives of objects and people. It stimulates the imagination of the viewer, creating "works for immersion".

 

Peter Thoms, awarded the Ruhr Prize for Art and Science, is a master of the game of colour and light, which he uses almost playfully to resolve the representational and abstract. From the Middle distance itself developed from the ordered chaos arises.

Jürgen Wölke - RETROSPECTIVE "assemblages - The world in miniature"

 

The artist Prof. Jürgen Wölke died in 2010. His main body of work was assemblages - patio-plastic material images reflecting what he calls "the world in miniature“. Large-scale works are located, for example, in New York's airport and at Leipzig Central Station as well as in numerous private collections. The Berlin Senate have presented numerous state guests with a Wölke assemblage as a gift.

 

Wölkes most common motives were those of his time battered facades of the German capital, small traditional shops, the Berlin corner pub and scenes from the lives of ordinary people. This work Wölke continued on Mallorca. Again, he found in the capital Palma facades and subjects worth replicating, and he created sensible environmental studies of documentary value. The largest German private collection of Wölke’s work is owned by the bankrupt entrepreneurs Schlecker and was dissolved as a result of the insolvency process.

 

Edith and Lutz Minkner were the main promoters of the artist and part of their Wölke collection is on show in Llucmajor.

1. News von Minkner & Partner

 

Caught: And again a lawyer's chancery was caught as a copy-holder! New copyright infringement with Lutz Minkner's " “SPAIN’S real estate adviser”  - All about law & taxation"

 

Spain’s real estate adviser – everything about “Law & Taxation” third edition was published in 2011. However, due to the unstable political situation in Spain and the ever-changing regulations, especially in the tax sector, the 4th edition will not be published until 2017. The current tax rates for the non- EU resident citizen regarding acquisition, possession and sale of a property in Majorca with regard to acquisition, value added tax, wealth tax income tax and  inheritance tax as well as and capital gains tax (Plusvalia) can be found In the Internet portal www.minkner.com.

 

The remainder the real estate advice is still current, which is why almost every month there is a broker or a lawyer, in violation of copyright laws who copies from Minkner and thus experts foreign competence as their own – trying to steal someone else work. In the last month, it was a law firm from Frankfurt that printed some pages from Minkner’s book without permission on its website. After being legally subjugated, they apologized stating "it was a regrettable mistake on the part of the internet agency commissioned, which had not been seen by their lawyers." These gentlemen do not seem to read their own website and certainly do not check the content. The question is, whether these lawyers look after their clients? 

 

2. Mallorca – Construction, Economy laws and taxes

 

(1) Construction

 

Lllucmayor – Campos:  This is what the motorway will look like

 

The island’s city council has published details on the construction of the planned motorway from Llucmajor to Campos. The road that runs between Llucmajor and Campos will be extended by 8,8 km with a total investment of 42 million euros. The existing road is to be partially straightened and increased to two lanes. Furthermore, there will be lay-bys and a central reservation. The extension is without a doubt necessary as this section of the motorway is accident prone. Although the new road will only be 42 metres wide and the original plan was for 49.2 metres (which would have meant 190,000 m² more asphalt), the environmentalists are not satisfied with the new project as it represents a dramatic change to the landscape.

 

(2) Economy

 

Balearic Economy: Experts are expecting 4% growth

 

The Balearic business association has stated that the economy is a lot stronger than in other autonomous regions of Spain. In the third quarter a growth of 4% was recorded. This is also the forecast for year for 2016. In all economic sectors - commerce, services, and skilled trades as well as in the construction and industrial sector - strong growth was recorded for the first three trimesters of 2016 and is also expected for the fourth quarter of 2016 too.

 

Tourism I: Even in September 2016 it marked the increase in passengers

 

Palma's Son Sant Joan airport is reporting record figures on a weekly basis. In the month of September 2016 there was once again a new passenger record with a total of 3.41 million passengers either arriving or departing. This is 9.5% more than in the same month the previous year and 2.88 million passengers were foreigners and 527,000 from Spain. The largest group were German passengers with 1.24 million, followed by the British with 785,000 passengers. In the month of September of 2016 there were a total of 23,722 flights, and 11.8% more than in the previous year.

 

Tourism II: Good hotel bookings rates due to the autumn holidays in Germany

 

The summer holidays seem to have blended seamlessly into the autumn holidays in Germany. Mallorca’s hoteliers are also looking forward to a high occupancy rate for October. In the centre of Palma and Playa de Palma, occupancy is between 75% and 80%. The Cala Millor, Paguera and Cala d`Or holiday resorts report similarly high figures. Palma's Son Sant Joan airport also reports that some 800,000 passengers passed through the airport.

 

Tourism III: Allsun continues to expand; For 2017 the opening of four new hotels are planned

 

Allsun, the hotel group of the tour operator Alltours, plans to open four new hotels in Mallorca next year. The hotels are being refurbished and modernised over the winter season and will open to the public for the summer season 2017. In Playa de Palma the hotel affected are two 4-star plus hotels - the Riviera Playa and the Cristobal Colom. Two further 4-star plus properties will open in Cala Millor (Amarac Suites) and Cala Ratjada (Lux de Mar).

 

Trade: IKEA - Extension and structural alterations have completed, Sales have doubled

 

IKEA the Swedish home and furnishing store, which has had a subsidiary in Palma’s commercial district Llevant since 1992, has completed its conversion and extension. Extension of the store has meant that the company has increased the sales area by total of 6,400 metre and thus doubled in size. However, the construction work is not finished: the older part of the building which is approx. 3,900 metres is now to be converted and will become a large warehouse.

 

Grape harvest: The happy wine producers have promised an excellent quality wine

 

Mallorca’s grape harvest will be starting in the next couple of days with the harvesting of the various red wines such as

(Cabernet Sauvignon, as well as Gorgollassa), that take longer to mature. The wine producers are very satisfied and promisingan excellent quality wine, which is due to the long dry period on the island. More sugar content and more flavours are the result of drought which varies from the rest of the island, which is the reason of loss of income because of the drought.

 

Mallorca - congresses: Melia wins contract for Congress Palace

Frequent readers of our newsletters will be surprised that news about the Congress Palace has disappeared from our pages. Well it’s done! The Congress Palace and the hotel, which had been accompanied by many years of bad luck and mishaps, will be run by the hotel group Melia, which was awarded the contract on 14th Oct 2016. What exactly Melia has to pay annually, is not yet known. The minimum bid in the call for tenders was € 1,558,000 annually, plus a profit participation of 5%.

 

(3) The law, taxes and finance

 

Tourism tax: Just in power and already the left wing government thinking in increase

 

There has long been political dispute over the introduction of the tourism tax. Now that it has been put into effect, and the protests of those involved in tourism have been limited, the greed of the left-wingers is still burning up: during the debate that took place in the Balearic Parliament regarding the 2017 budget, the left wing were very vociferous regarding   increasing the tourism or environmental tax or introducing a new tax on "emissions". There was a violent protest particularly from the hoteliers, who fear that this could impair the competitiveness of tourism compared to other destinations. “Some surprises are still in store.”

HERMAN and OTTO QUIRIN - "Summertime"

 

There is a nice summer feeling since the 28th July 2016 in the Art Gallery Minkner in Santa Ponca. Two artists with different styles and vita HERMAN & OTTO QUIRIN present their work with the theme “Summertime.” HERMAN (with one N from Paderborn) has for many years been among the most prolific and successful pop painters. Unmistakeable and distinctive with his rough edge style; Herman’s paintings deal mostly with day to day occurrences of life. Sometimes humorous and cryptic, sometimes bitingly satirical large parts of his works are subtle subjects. As a cartoonist Herman worked for many publishing companies. His cartoons can be found on books, postcards and on consumer goods (as well as on millions of sugar sachets!)

 

OTTO QUIRIN (born in 1927) is a painter of lyrical abstraction. From 1948 to 1955 he studied at the Dusseldorf Art Academy, the Nordic Art School Bremen, and the University of Hamburg studying painting, art history, German and philosophy. He worked as a teacher and presenter of art. From 1966 to 1970 he lived in Chile and directed the Instituto Aleman Carlos Anwander. While in Chile he had painted the portrait of Salvador Allende and Pablo Neruda. From 1971 to 1978 he was Director of the Hansa-College in Hamburg and then until 1984 he was Director of the German School in Barcelona. From 1950 until today Quirin has had numerous solo art exhibitions and participated in group exhibitions in Germany, USA, Luxembourg, Denmark, Spain, Bulgaria and (of course) Chile. Mr. Quirin has received numerous awards and art prizes. From 1990 to 2008 he had his studio in Hamburg and also in Blanes / Girona - Catalonia. This is where the bright beach paintings were created which are now displayed in the “summertime” Exhibition at the Galeria de Arte Minkner.

Gastro Exhibition MARISGALICIA will run until 23rd of October 2016

 

The Gastro Exhibition MARISGALICIA which is presently taking place will run until 23rd of October 2016.  In a 1,200 m² marquee, Galician chefs show what Galician cuisine has to offer and according to the organizers, 90 tons of seafood, and 30,000 bottles of Albariño will served to some 130,000 guests. 30th of October the 10km Running Course on the Playa de Palma

 

The M & P newsletter has reported that various entrepreneurs have decided to collaborate and to enhance the area of Playa de Palma, under the label of “Palma Beach Project” with sports and entertainments as well as events. On the 30th of October Palma Beach is organising an event the “Running Course” a ten kilometre run has been organised along Playa de Palma’s promenade.  The event will start at 10.30 from the MG café and then up to the club Naútico in Arenal and then back to the Chiringuito Beach House. “Litoral Ponent” is the name of the latest city council project in which 25, 4 million euros will be invested in the redevelopment of the western part of the city. 50% of this amount is funded by the EU and has already been approved. Areas to be redeveloped are the districts of Es Jonquet, Son Armadans, El Terreno, Porto Pi, Cala Major and Sant Agustin. It is hoped the investment will create a "smarter and more sustainable urban model". What the redevelopment will look like has still not been decided.  M&P newsletter will keep you posted.

 

Palma: Part of the Via Cintura in Son Ferriol will be re-tendered

 

A new episode in the series: news from the bedlam of the Balearic Government: The expansion of the second bypass motorway around Palma has been delayed. Originally, the completion was scheduled for April 2016. An important 3km long section has to be re-tendered after the Island Council terminated the contract without any notice to the previously authorized contractors. The affected area is Son Ferriol and will connect the airport motorway in Coll d`en Rabasssa to the motorway to Manacor. The delays are mainly based on bad planning: A bridge could not be built because existing electricity and gas lines as well as fibre optic cable would have been destroyed. Nor was it possible to build an underpass as this would have meant that it would have to be built under the sea level.

 

(2) Economy

 

Tourism I: Eurowings to fly to Leipzig, Dresden, Karlsruhe / Baden-Baden and Nurembergfrom Mallorca

 

As of May 2017 Eurowings will have A320s based in Mallorca and  will be flying to Leipzig, Dresden, Karlsruhe / Baden-Baden and Nuremberg. The already existing routes to Salzburg and Dortmund will be operated in shorter time intervals. The new routes will operate five to seven times a week. Speculations that Eurowings will take flights from Air Berlin at start of the winter flight plan have not yet been confirmed

 

Tourism II: Airberlin - despite restructuring planned and booked flights are operated

 

The restructuring measures in Air Berlin have many tourists and passengers unsure whether planned and booked flights operated by Air Berlin, NIKI and Belair will be operated. In a press release Air berlin CEO Stefan Pichler has assured that all flights would operate as planned.  If any flight plan modifications occur due to restructuring, these will be announced in due course.

 

Tourism III: hotels well booked in October

 

It appears that this year the summer season will run into the off peak season. Hotels have reported good occupancy rates for October. The Mallorcan hotel association FEHM has announced that in early October, hotels have a 70% occupancy rate which is expected to increase during the month. The hotels in the south and southwest of the island, as well as in Palma and the surrounding areas, have recorded particularly high bookings (80%). Only in the east of the island are many hotel beds still available.

 

(3) The law, taxes and finance

 

Restaurant terraces: business associations are demanding legal security

 

Palmas left wing city government have made themselves unpopular with Palmas restauranteurs. With statements such as "The street belongs to the people and not the restauranteurs" and the announcement of further restrictions whereby they want to restrict the use of terraces of restaurants, cafes and bars in Palma’s city even more so.  Palma’s restaurant association, the employers' association and the trade association for small and medium sized businesses, en masse, have called for regulation of these problems. The government and the opposition will have to sit down together and create regulations that will outlast a legislature. When the rules are changed every four years it is impossible to invest and create jobs.  "We're tired and have had enough," said the head of the association Alfonso Robledo.

 

European Health care Card

 

The Ministry of Health of the Balearic Islands reminds foreign guests who are insured under the statutory scheme, that prior to departure they should apply for a European health card, whereby they can receive treatment free of charge in public hospitals for any accidents incurred whilst in Spain. In the first eight months of this year, the Balearic health authority has already provided care for 13, 8 million European travellers, who were not in possession of the European health card and needed medical attention. This is 19% more than last year.

The Minkner art gallery is holding, for the first time, an exhibition of photographic art work by the young photographic artist, Constantin Rahmfeld. There are two reasons, the first one being, that photography has been recognised as art in the artistic world and the second reason being that Constantin Rahmfeld has worked for Minkner & Partner for the last eight years, and we think that his work should be introduced into a wider circle.

 

Mallorca is the island of “fiestas”! Nearly every local village has its own patron saint and fiestas are held in their honour. On these mystical, bustling and happy occasions, Constantin Rahmfeld loves to capture the special moments with his camera. The photographs for this Exhibition were taken on such occasions, where only the camera and the photographer hold the moment, forever. Whilst looking through the photographs a quote from Friedrich Dürrenmatt comes to mind:

“Anyone can take a photograph. Even a machine. But not everyone can observe. Photography is only art when the artist portrays it correctly. Observation is an elementary poetic process. The reality must be formed, to be brought to life.”

HERMAN and OTTO QUIRIN - "Summertime"

 

There is a nice summer feeling since the 28th July 2016 in the Art Gallery Minkner in Santa Ponca. Two artists with different styles and vita HERMAN & OTTO QUIRIN present their work with the theme “Summertime.” HERMAN (with one N from Paderborn) has for many years been among the most prolific and successful pop painters. Unmistakeable and distinctive with his rough edge style; Herman’s paintings deal mostly with day to day occurrences of life. Sometimes humorous and cryptic, sometimes bitingly satirical large parts of his works are subtle subjects. As a cartoonist Herman worked for many publishing companies. His cartoons can be found on books, postcards and on consumer goods (as well as on millions of sugar sachets!)

 

OTTO QUIRIN (born in 1927) is a painter of lyrical abstraction. From 1948 to 1955 he studied at the Dusseldorf Art Academy, the Nordic Art School Bremen, and the University of Hamburg studying painting, art history, German and philosophy. He worked as a teacher and presenter of art. From 1966 to 1970 he lived in Chile and directed the Instituto Aleman Carlos Anwander. While in Chile he had painted the portrait of Salvador Allende and Pablo Neruda. From 1971 to 1978 he was Director of the Hansa-College in Hamburg and then until 1984 he was Director of the German School in Barcelona. From 1950 until today Quirin has had numerous solo art exhibitions and participated in group exhibitions in Germany, USA, Luxembourg, Denmark, Spain, Bulgaria and (of course) Chile. Mr. Quirin has received numerous awards and art prizes. From 1990 to 2008 he had his studio in Hamburg and also in Blanes / Girona - Catalonia. This is where the bright beach paintings were created which are now displayed in the “summertime” Exhibition at the Galeria de Arte Minkner.

ELENA GATTI and Peter Thoms - from graphic to abstract

 

One aspect of the history of painting of the 20th century is the shift from figurative representation through several development steps to a gradual abstraction whose ultimate goal was the complete disintegration of the graphic. The result is an autonomous artistic statement. The Minkner Art Gallery in Santa Ponsa offers a new collective exhibition by the artists Elena Gatti and Peter Thoms, who follow the path from graphic to abstract through their work.

 

Elena Gatti was born in 1950 in Argentina, and now lives and works in her adopted home of Mallorca. By sketchy allusions and overwriting them to evolve forms, light and shadow, and thus comes to new perspectives of objects and people. It stimulates the imagination of the viewer, creating "works for immersion".

 

Peter Thoms, awarded the Ruhr Prize for Art and Science, is a master of the game of colour and light, which he uses almost playfully to resolve the representational and abstract. From the Middle distance itself developed from the ordered chaos arises.

Jürgen Wölke - RETROSPECTIVE "assemblages - The world in miniature"

 

The artist Prof. Jürgen Wölke died in 2010. His main body of work was assemblages - patio-plastic material images reflecting what he calls "the world in miniature“. Large-scale works are located, for example, in New York's airport and at Leipzig Central Station as well as in numerous private collections. The Berlin Senate have presented numerous state guests with a Wölke assemblage as a gift.

 

Wölkes most common motives were those of his time battered facades of the German capital, small traditional shops, the Berlin corner pub and scenes from the lives of ordinary people. This work Wölke continued on Mallorca. Again, he found in the capital Palma facades and subjects worth replicating, and he created sensible environmental studies of documentary value. The largest German private collection of Wölke’s work is owned by the bankrupt entrepreneurs Schlecker and was dissolved as a result of the insolvency process.

 

Edith and Lutz Minkner were the main promoters of the artist and part of their Wölke collection is on show in Llucmajor.

There will also be a Thanksgiving Day event with music and a buffet as well as a flea market. The charity is working in co-operation with the German protestant church here on the Balearic Islands in the Santuario de Nuestra Consolación in Santany. There will also be mass in the Catholic Church San Bartomeu in the village of Alaro.

 

Everyone who knows the extensive social commitment of Minkner & Partner will notice that support of this event series is atypical: Usually we only promote organisations "on our doorstep", because in Majorca we know that the organisations use the donations responsibly and we are also able to monitor the use of donations. 2. Mallorca – Construction, Economy laws and taxes

 

(1) Construction

 

Palma - Playa de Palma: Shopping Centre Palma Springs has been put “on hold”

 

The planned shopping centre in Playa de Palma has been put on hold, as the Balearic Supreme Court has upheld the decision by the building authorities not to grant a building licence. This doesn’t mean that the project has been totally abandoned, the rejection was actually based primarily on the land in question which was undeveloped. However, basic infrastructure (roads, sewers and connection to power supply) is a pre-requisite for granting planning permission. Initiator of the project, the developer Unibaiball Rodamco SLU., envisages the project as a shopping and entertainment centre with 200 commercial premises, 2 cinemas and 3,700 parking spaces. The investment is said to be 225 million euros.

 

Porto Cristo: The harbour will be renewed as from the Autumn 2016

 

The Balearic council has agreed to invest 1 million euros for the restoration of the harbour in Porto Cristo. The construction should begin in the autumn of 2016. Three quarters of the amount is going to be invested in the restoration of the breakwater around the Riuet, to ensure its safety. Furthermore, the terraces and the sightseeing platforms need to bewaterproofed, as in the underlying premises water is coming in.

 

Llucmayor – Campos: Roadworks for the Motorway are planned for the beginning of 2017

 

An accident black spot in the southeast of Mallorca should be eliminated in the next few years: construction work on an extension of the motorway from Llucmajor to Campos will begin early 2017. It only requires the approval of the Ministry of Environment of the Balearic Islands to make the necessary tender at the turn of the year. Construction will take about 2 years, so that the new section of the motorway should be open at the beginning of 2019

 

(2) Economy

 

Tourism I: Son San Joan Airport reports record figures for the month of August 2016

 

The airport administration of Son San Joan has announced a new record; almost four million passengers have passed through Palmas airport during the month of August. This is 5, 5 % more than the previous year. The number of take offs and landings of aircrafts has increased by 9,1 %. Flights to and from Germany were the most popular and on these routes alone there were 1,3 million passengers, an increase of 8 % compared to the previous year.

 

Tourism II: Eurowings comes to Palma

 

Each month Mallorca’s Son Sant Joan airport reports new records in the number of visitors. (supra). Lufthansa’s subsidiary Eurowings also want to participate and have a share in the business. The group management have stated that as from May 2017 Eurowings will base two aircrafts permanently at Palma’s Son San Joan airport. There will be numerous direct flights to Germany as well as other European destinations. Eurowings will need to hire 75 additional employees, and have plans across Europe to develop a system for low cost/ budget flights. There are unconfirmed reports that Lufthansa is negotiating with Air Berlin to take over a substantial part of Air Berlins network routes to assist with the rent.

 

German Fresenius Helios Group purchases Spanish Clinique Quironsalud for 5.67 Billion Euros

 

German Fresenius Helios Group has purchased the Spanish hospital chain Quironsalud for 5.67 billion euros. Probably the largest German investment this year is in the bag, but still needs to be approved by the competent authorities. The package includes Palma Planas & Clinica Rotger in Mallorca, who both welcome the takeover as they have many German patients. The hospitals will continue to function as normal. No redundancies are planned.

 

(3) The law, taxes and finance

 

New regulations for beach clubs

 

The Balearic Government wants to regulate the so called beach clubs and at the same time impose more taxation. It has been observed, with a certain amount of suspicion, that more and more beach bars are converted into nightclubs and public coastal areas have been used for private & commercial purposes. Hardly surprisingly, the Balearic Government is being supported by the nightclub operators who are trying to resist this new and unwelcome competition. As beach clubs are open-air locations, the problem of noise is always a cause for complaint. In addition, beach clubs that are formally conducted as restaurants only have to pay 10 % IVA on their revenues, while discos and nightclubs have to pay 21 %.

Jürgen Wölke - RETROSPECTIVE "assemblages - The world in miniature"

 

The artist Prof. Jürgen Wölke died in 2010. His main body of work was assemblages - patio-plastic material images reflecting what he calls "the world in miniature“. Large-scale works are located, for example, in New York's airport and at Leipzig Central Station as well as in numerous private collections. The Berlin Senate have presented numerous state guests with a Wölke assemblage as a gift.

 

Wölkes most common motives were those of his time battered facades of the German capital, small traditional shops, the Berlin corner pub and scenes from the lives of ordinary people. This work Wölke continued on Mallorca. Again, he found in the capital Palma facades and subjects worth replicating, and he created sensible environmental studies of documentary value. The largest German private collection of Wölke’s work is owned by the bankrupt entrepreneurs Schlecker and was dissolved as a result of the insolvency process.

 

Edith and Lutz Minkner were the main promoters of the artist and part of their Wölke collection is on show in Llucmajor.

25th September 2016, SOS Animal Party in Puerto Portals

 

On 9th of September the animal charity organization SOS Animals in Puerto Portals will once again be organising the SOS Animal Party: A whole Sunday with plenty of entertainment for dogs and cats in need. Up to 3,000 visitors are expected at this ever-popular event. Attractions include a flea market, raffle, choosing the "cutest dogs" plus food stalls and music. 1. News from Minkner & Partner

 

New team member in Minkner & Partner: Our new lawyer Almudena Barba

 

One of the fundamental departments in Minkner & Partner is our contracts department, which is responsible for the preparation of multilingual purchase agreements, in particular the option to purchase contracts, often working together with the lawyers chosen by the interested parties, examining the documentation of the interested parties and the property in question as well as arranging notary appointments, together with the employees of the notary. Kinga Vereb has been in charge of this department for many years, however due to further expansion Minkner & Partner have now increased the contract management department and Almudena Barba a Spanish lawyer will be joining us as of 1st September 2016. Mrs. Barba speaks Spanish, English and German. She has a double degree in Law and Economics from the University of Bilbao, she has also completed additional studies in Heidelberg and Madrid and most recently worked in a law firm in Madrid and the legal department of Melia Hotels International group in Palma. Dear friends: We would like to make you aware of a series of upcoming events that are sponsored by our company. “You touch Africa” is a non-profit organisation that was founded by a former colleague Mrs. Claudia Nagyvan who, after travelling extensively through Tanzania, gained an in depth knowledge of the needs of the locals and via a network of reliable and local acquaintances in Africa has the guarantee that 100 % all of the donations will be used in the areas where most needed. Claudia has organised a diverse and varied programme from the 10th –16th of October which includes an exhibition, with music and tapas in the CCA in Andratx and a 3 course meal with jazz music in the restaurant Bon Lloc in Palma. There will also be a Thanksgiving Day event with music and a buffet as well as a flea market. The charity is working in co-operation with the German protestant church here on the Balearic Islands in the Santuario de Nuestra Consolación in Santany. There will also be mass in the Catholic Church San Bartomeu in the village of Alaro.

 

Everyone who knows the extensive social commitment of Minkner & Partner will notice that support of this event series is atypical: Usually we only promote organisations "on our doorstep", because in Majorca we know that the organisations use the donations responsibly and we are also able to monitor the use of donations. By supporting "You touch Africa" we move away from our usual area for two reasons: Firstly, because we know the organiser and trust her. Secondly, because in view of the current refugee problems it appears to be undisputed that trusted organisations deserve all our help, as they trying to give people a decent life, an education and therefore a future in their country.

2. Mallorca – Construction, Economy laws and taxes

 

(1) Construction

 

Palma/ Molinar: After the refusal of the extension of the harbour, will Palma extend the Promenade

 

Disputes over the planned extension of the port of Molinar by the Port Authority, appear to be a thing of the past. Now Palma’s City Council has presented a new plan for the outskirts of the urban area: the promenade of Molinar is to be extended in two phases. The first one is to prohibit the movement of traffic, except for residents, on the stretch of road that passes in front of the yacht club Molinar. Further structural changes in a second phase will be decided after reviewing the results of phase.

 

Palma: The old hospital Son Dureta to be converted into a nursing home

 

For the last six years the state hospital Son Dureta has been empty, after relocation to new hospital premises Son Espases and there are now plans to turn the old hospital into a nursing home. For several years there have been complaints regarding the lack of places in nursing homes in the public health system. The elderly in need of care are currently in Son Espases. The responsibility of these patients lies with the hospital. According to a statement from the Ministry of Health there is currently a waiting list of 1000 people seeking a place in a nursing home.

 

Palma: Groupo Proturhotels to build a 4 Star hotel in Palma

 

The Mallorquin hotel group Protour is to build a 4 Star hotel “Naisa Palma” in the Calle Ballester, a side street off the Paseo Maritimo that will be open its doors in the autumn of 2017. Construction is due to commence at the beginning of September, and the investment capital is estimated at 17 million Euros. The hotel will comprise 100 rooms and eight floors as well as a roof terrace with a swimming pool; the hotel will also have an underground garage with 25 parking spaces.

 

Co’ll d ‘en Rabassa: Shopping and Events centre FAN almost completed

 

Construction workers are presently working overtime in order to ensure that the new shopping centre FAN will open its doors on the 22nd September. There will 120 shops vying for the attention of customers in order to make them part with their money. Shops include Primark, H&M, C&A, Deichmann, Media - Markt, and Cortefiel. The latest tenant is Starbucks whose installations will have specially lit rooms and 5-metre-high ceilings.

 

(2) Economy

 

Tourism: New record figures from Palma’s airport

 

The airport administration AENA reports new records for the month July 2016. In July of this year 3.925.191 passengers passed through the airport which is 12,8 % more than the previous year. The majority of the passengers came from Germany the number of flights increased by 12,7 % up to a total of 27.583. The overall balance for the first seven months of 2016 is as follows: 14,560,000 passengers have passed through the airport which is 11,6 % more than in the same period of the previous year.

 

Commerce: ALDI will be open its 7th store on 9th of September 2016 in Manacor

 

Aldi is opening its 7th subsidiary directly on the Palma – Manacor road at km 47. The supermarket will have 1,500 of commercial space with 1,500 different products and 97 parking spaces. Opening times: Monday - Saturday 9.00 h to 22.00 h, Sunday 9.00 h to 15.00 h. The opening of Aldi’s new supermarket is creating 20 new jobs in Mallorca. Since 2002 Aldi has invested in Spain and has currently has 260 stores.

 

(3) The law, taxes and finance

 

Party pooper Aurora Jhardi (Palma’s deputy mayor) wants to restrict café terraces

 

Palma’s deputy mayor Aurora Jhardi of the Podemos party already had her fingers burned last year when she wanted to ban the street cafés on the Born. Following protests from residents and a public opinion poll (quote: ‘streets belong to the citizens not the hoteliers or businesses’) she rescinded her plan. However, it appears the party pooper Jhardi has not learned her lesson. She has now presented a new development plan which provides further restrictions on outdoor terraces. The restaurant association was quick to protest as they foresee an end to 500 such terraces. In principle Jhardi appears willing to talk but still defends the restrictive trend of the plan.

 

New Property laws regarding Summer Rentals on the Balearic Islands for the 2016

 

One of the promises of the left-wing government was regulating the holiday rentals on the Balearic Islands. Originally, the law should have come into force in September 2016 however, "because of the complexity of the issue" the Tourism Minister Biel Barceló now states that it more likely to be at the end of the year. At present, holiday rentals in the Balearics is in a legal grey area. According to the tourism lawonly rental of detached houses is currently valid, but not apartments. According to the Balearic Government, the number of private vacation rentals has tripled in the last two years. The Hoteliers Association is annoyed as it regards illegal vacation rentals as a distortion of competition. The Balearic government has promised that it intends to incorporate in the new law a more stringent control of private holiday rentals in the future. Private landlords should be required, as hoteliers are to inform the police constantly about a change of guests.

HERMAN and OTTO QUIRIN - "Summertime"

 

There is a nice summer feeling since the 28th July 2016 in the Art Gallery Minkner in Santa Ponca. Two artists with different styles and vita HERMAN & OTTO QUIRIN present their work with the theme “Summertime.” HERMAN (with one N from Paderborn) has for many years been among the most prolific and successful pop painters. Unmistakeable and distinctive with his rough edge style; Herman’s paintings deal mostly with day to day occurrences of life. Sometimes humorous and cryptic, sometimes bitingly satirical large parts of his works are subtle subjects. As a cartoonist Herman worked for many publishing companies. His cartoons can be found on books, postcards and on consumer goods (as well as on millions of sugar sachets!)

 

OTTO QUIRIN (born in 1927) is a painter of lyrical abstraction. From 1948 to 1955 he studied at the Dusseldorf Art Academy, the Nordic Art School Bremen, and the University of Hamburg studying painting, art history, German and philosophy. He worked as a teacher and presenter of art. From 1966 to 1970 he lived in Chile and directed the Instituto Aleman Carlos Anwander. While in Chile he had painted the portrait of Salvador Allende and Pablo Neruda. From 1971 to 1978 he was Director of the Hansa-College in Hamburg and then until 1984 he was Director of the German School in Barcelona. From 1950 until today Quirin has had numerous solo art exhibitions and participated in group exhibitions in Germany, USA, Luxembourg, Denmark, Spain, Bulgaria and (of course) Chile. Mr. Quirin has received numerous awards and art prizes. From 1990 to 2008 he had his studio in Hamburg and also in Blanes / Girona - Catalonia. This is where the bright beach paintings were created which are now displayed in the “summertime” Exhibition at the Galeria de Arte Minkner.

ELENA GATTI and Peter Thoms - from graphic to abstract

 

One aspect of the history of painting of the 20th century is the shift from figurative representation through several development steps to a gradual abstraction whose ultimate goal was the complete disintegration of the graphic. The result is an autonomous artistic statement. The Minkner Art Gallery in Santa Ponsa offers a new collective exhibition by the artists Elena Gatti and Peter Thoms, who follow the path from graphic to abstract through their work.

 

Elena Gatti was born in 1950 in Argentina, and now lives and works in her adopted home of Mallorca. By sketchy allusions and overwriting them to evolve forms, light and shadow, and thus comes to new perspectives of objects and people. It stimulates the imagination of the viewer, creating "works for immersion".

2. Mallorca – Construction, Economy laws and taxes

 

(1) Construction

 

Palma: Palace of Congress- Three Companies to bid for Tender No. 6

 

The Congress Centre has been finished. Only the seating for the Auditoriums is missing. The time to present a tender is over and there are just 3 contenders remaining: The Melia Group, Barcelo from Mallorca and the Hotusa Hotel Group from Catalonia. The minimum offer for the Hotel & Congress Centre should be approximately € 1.585.000 per annum. Representatives from the Government and from the City of Palma will peruse the various offers and will make a decision by the end of the year.

 

Palma/ Es Molinar: The ARCA Conservation Association demands restrictions from the Gastronomy

 

The Conservation Association ARCA has presented a document declaring that the former fishing village, Es Molinar- located on the outskirts of Palma, has lost its original, natural charm, mainly due to the huge increase in the gastronomical businesses. Numerous new buildings would not fit into this historical image. A comparison was made to the trendy district of Santa Catalina and in particular Calle Fabrica- where in the meantime a Moratorium is now in place banning new shops, which will help to keep the balance of residential and commercial. ARCA is requesting a similar Moratrium for Es Molinar.

 

Palma/ Es Monlinar: The Balearic Harbour administration does not want to extend Harbour concession

 

Between the Balearic Harbour administrations, the City of Palma and the Yacht Club there is a long standing disagreement over the extension of the harbour. The Yacht Club had originally planned an extension of 75 Berths to 315 and after protests from the harbour and the city administration they reduced this to 220. The original planning was for 70.000 m2 constructed area which was then reduced to 40.000 m2. Only a significant extension of the harbour guaranteed profitability and security. Their rivals wanted the harbour to remain with the original 75 berths and thus leave the harbour with its original character. The possibility of having the Harbour and the buildings put under a conservation order was also discussed. The Harbour officials and the City of Palma officials ended this never ending discussion quite drastically by deciding not to extend the concession, which ends in March 2018. The Yacht Clubs bluff has been called!

 

Palma/ Son Vida Golf: Inauguration of the New Club House, Labour Government shows adaptability!

 

On the 22nd July, The Schörghuber Group had the Inauguration of the new clubhouse of the Son Vida Golf Course and they combined this event with their traditional Summer Party. The Schörghuber Group, owners of the luxury hotels Castillo Son Vida, St. Regis Mardavall, Sheraton Arabella Golf and the Golf Resort Son Vida, are one of the most important international investors in high quality tourism on Mallorca. Perhaps it was a general reluctance to have any form of contact with so much capital and/ or perhaps controversy with the hotel industry in general, whatever the reason government officials boycotted Schörghubers 2015 Summer Party.

In the meantime, it is possible that even the “Left” must recognise and acknowledge how important the commitment of the Schörghuber Group and other national & international investors is for the Baleares. This year the Summer Party was attended by top government officials such as Prime Minister Francina Amengol, Tourism Minister Biel Barcelo, the General Director for Tourism, Pilar Carbonell and the Mayor of Palma- Jose Hila. Together they praised the Schörghuber Group for their engagement in Mallorca and gave confirmation of their unified support for the promotion of golf tourism. Well done Francina!

 

Palma: British consortium plans Theme Park with a planned investment of 500 million euros

 

The British real estate and investment company INTU plans to build an Amusement Park in Mallorca with a capital expenditure of 500 million euros. The area intended is approximately 180.000m2 and is located on the outskirts of Palma close to the Atletico Baleares Stadium. The owners are currently in negotiations with the present authorities and this has been well received, says the official company representative. On the site there are plans for a botanical garden, an artificial lake, an Open-Air Theatre, a tram, a Wave House, Ski & Ice tracks, a Deli/gastronomy market and various shopping offers are waiting to be installed. A time frame for the implementation of this work has not yet been announced. A similar project is already functioning since 2012 by INTU in Zaragoza under the name "Puerto Valencia." This is visited annually by 18 million guests. Just before printing this newsletter we have received a message that the current Palma City Council has rejected the project; stating “it is not inconsistent with local zoning.” INTU comment: We have deliberately not given a set time frame to this project as governments in Spain have short expiry dates.

 

Paguera/ Camp de Mar: PP is committed to pedestrian and bicycle pathways between the two resorts

 

The conservative party “PP” of Calvia City Council wants to get involved in the construction of a pedestrian and bicycle path between the holiday resorts of Paguera and Camp de Mar along the southwest of the island. The two different villages are presently only accessible by cobbled streets. The PP conservative party idea is to take the opportunity to entice the cycling tourism to come to the Southwest of the Island. They are also considering, in the long term, extending this pedestrian & cycle way to Pto. Andratx.

 

(2) Economy

 

Tourism I: 86.6 % Bed Occupancy on the Baleares in June 2016

 

After recently published data from the Spanish Statistics Office, the Balearic Islands had in June 2016 with 86.6 %, the highest bed occupancy in Spain. In second and third place were the Canary Islands with 77.6 % and Valencia with 66.2 %. The hotel occupancy in Spain, for the month of June, increased to 34.9 million which showed an 8.9 % increase for the same time of the previous year.

 

Tourism II: 23rd of July - Highest Record for Palmas San Joan Airport

 

Never before in the history of Palmas airport Son San Joan have there ever been as many passengers! On the 23rd July there were 176.470 passengers and 1028 aircrafts were dealt with. Contrary to the concern of theairport administration and considering the amount of aircrafts that had to handled, there were hardly any delays! Mallorca’s hoteliers and entrepreneurs are certain the 2016 summer season is going to be one of the most successful seasons of all times.

 

Tourism III: Problems caused by the insolvency of "Low-Cost Travel" and Unister ("Ab-in-the-holidays")

 

The Ministry of Tourism reported problems related to the bankruptcy of British organizer "Low-cost Travel" and the German company Unister ("Ab-in-holidays"). From the Low-Cost Travel collapse around 30,000 British holidaymakers, who already had their holiday booked, will now lose their holidays. There are also many hoteliers affected as debts of approximately 50 million euros are still outstanding. With regard to the bankruptcy of Unister a survey by the Tourism administration is still pending.

 

Trade I - Aldi will be opening another subsidiary in Manacor in September 2016

 

The German food discount store ALDI is expanding with more subsidiaries in Spain. The company already has 250 stores on the Spanish mainland. In Mallorca there are currently 6 stores which all opened up in one swoop last year! In September 2016 ALDI wants to open up another subsidiary, this time in Manacor. The other Mallorcan branches are located in Palma, Palma Nova, Magaluf, Marratxi and Inca. The ALDI management have stated that the total sales area in Mallorca is approximately 7.000 m².

 

Trading II: The French entrepreneur BRICOMART has opened up a Home/ Hardware store in Mallorca

 

Following the trend of Leroy Merlin, Bricodépôt and Baumark, the French group Bricomart has opened a new store in Mallorca. The new homeware store is located in the industrial area of Son Morro in Palma which is already a prominent area for hardware stores such: (Ikea, Lidl, Aldi, Müller). The commercial area consists of 8,000 m². Around 100 employees have found a new workplace and the total investment is approximately 14 million euros. Bricomart already has 16 stores in Spain.

 

Trade III: Carrefour Shopping Centre near completion and nearly all the retail space has been rented

 

In September, the new Carrefour shopping centre "FAN Mallorca Shopping" is scheduled to open in Coll d`en Rabassa. The sports company “Decathlon” have rented an area of 2,000 m² so now the FAN retail space is almost completely rented. Fan Mallorca Shopping has a total of 120 stores. Other tenants are: Adidas, Ritual, H & M, Primark and Mediamarkt.

 

(3) The law, taxes and finance

 

Balearic Parliament extended derogation: Building licenses for projects without drains

 

For decades, EU law requires the municipalities to issue building permits only if the property in question is connected to the sewer. In the past, the Balearic Government had failed to comply with these requirements and building permits granted for plots that were not connected to the public supply and disposal. The relevant legislation for the Balearic Islands expired in June 2016. In about a hundred urbanisations with about 10,000 plots, for example in Andratx, Palma-Son Vida, Alcudia and Llucmajor, the expiry of the special regulations resulted in a freeze of construction. TheBalearic Parliament decided in a meeting on the 21st of July 2016 that the exemption should be extended by six years under the conditions that the lack of infrastructure measures would actually be implemented. The Newsletter will keep you informed as soon as the regulations are implemented.

 

The Land Registry office has reportedly found 32,200 illegal constructions by using “Drones” and is now aiming to collect more taxes

 

The Spanish land registry offices have - unlike, for example, in Germany - primarily the function to provide a basis for calculating the local taxes. For this reason there are differences between the land registry and actual portfolio: The owner (taxpayer) is not interested to give notice of any enhancements to the property, the Land Registry Office however, want to know this information for taxation purposes. With the help of drones, tax inspectors have been in 37 municipalities of the islands (e.g. Andratx, Calvia, Santanyi, Alcudia, Son Servera, Ses Salines) and have discovered 32,200 homes in which such changes have not been given to the Land Registry Office. This will result in a review procedure by the municipalities with tax realignments. The Treasury expects annual revenue increases of 36 million euros. The controls have been ongoing since 2014 and are set to continue. The municipalities of Pollenca, Capdepera, Soller and Algaida are next on the list.

3. Galeria de Arte Minkner

 

HERMAN and OTTO QUIRIN - "Summertime"

 

There is a nice summer feeling since the 28th July 2016 in the Art Gallery Minkner in Santa Ponca. Two artists with different styles and vita HERMAN & OTTO QUIRIN present their work with the theme “Summertime.” HERMAN (with one N from Paderborn) has for many years been among the most prolific and successful pop painters. Unmistakeable and distinctive with his rough edge style; Herman’s paintings deal mostly with day to day occurrences of life. Sometimes humorous and cryptic, sometimes bitingly satirical large parts of his works are subtle subjects. As a cartoonist Herman worked for many publishing companies. His cartoons can be found on books, postcards and on consumer goods (as well as on millions of sugar sachets!)

 

OTTO QUIRIN (born in 1927) is a painter of lyrical abstraction. From 1948 to 1955 he studied at the Dusseldorf Art Academy, the Nordic Art School Bremen, and the University of Hamburg studying painting, art history, German and philosophy. He worked as a teacher and presenter of art. From 1966 to 1970 he lived in Chile and directed the Instituto Aleman Carlos Anwander. While in Chile he had painted the portrait of Salvador Allende and Pablo Neruda. From 1971 to 1978 he was Director of the Hansa-College in Hamburg and then until 1984 he was Director of the German School in Barcelona. From 1950 until today Quirin has had numerous solo art exhibitions and participated in group exhibitions in Germany, USA, Luxembourg, Denmark, Spain, Bulgaria and (of course) Chile. Mr. Quirin has received numerous awards and art prizes. From 1990 to 2008 he had his studio in Hamburg and also in Blanes / Girona - Catalonia. This is where the bright beach paintings were created which are now displayed in the “Summertime” Exhibition at the Galeria de Arte Minkner.

ELENA GATTI and Peter Thoms - from graphic to abstract

 

One aspect of the history of painting of the 20th century is the shift from figurative representation through several development steps to a gradual abstraction whose ultimate goal was the complete disintegration of the graphic. The result is an autonomous artistic statement. The Minkner Art Gallery in Santa Ponsa offers a new collective exhibition by the artists Elena Gatti and Peter Thoms, who follow the path from graphic to abstract through their work.

 

Elena Gatti was born in 1950 in Argentina, and now lives and works in her adopted home of Mallorca. By sketchy allusions and overwriting them to evolve forms, light and shadow, and thus comes to new perspectives of objects and people. It stimulates the imagination of the viewer, creating "works for immersion".

 

Peter Thoms, awarded the Ruhr Prize for Art and Science, is a master of the game of colour and light, which he uses almost playfully to resolve the representational and abstract. From the Middle distance itself developed from the ordered chaos arises.

Jürgen Wölke - RETROSPECTIVE "assemblages - The world in miniature"

 

The artist Prof. Jürgen Wölke died in 2010. His main body of work was assemblages - spatio-plastic material images reflecting what he calls "the world in miniature“. Large-scale works are located, for example, in New York's airport and at Leipzig Central Station as well as in numerous private collections. The Berlin Senate have presented numerous state guests with a Wölke assemblage as a gift.

 

Wölkes most common motives were those of his time battered facades of the German capital, small traditional shops, the Berlin corner pub and scenes from the lives of ordinary people. This work Wölke continued on Mallorca. Again, he found in the capital Palma ​​facades and subjects worth replicating, and he created sensible environmental studies of documentary value. The largest German private collection of Wölke’s work is owned by the bankrupt entrepreneurs Schlecker and was dissolved as a result of the insolvency process.

 

Edith and Lutz Minkner were the main promoters of the artist and part of their Wölke collection is on show in Llucmajor.
