Minkner & Partner Events in April 2017

 

Spring has begun and this is the time when Minkner & Partner invites its customers and friends to various events. The first of these takes place on 8th April in the Bodega Santa Catarina ‘Bilder aus Ausstellung’ (Pictures of an exhibition) with the artists Prof. Wolfgang Seifen (piano) und Wilfried Lachermair (see additional photos and info in part 4 events and tips). Following this on 13th April (Maundy Thursday) is the inauguration of the ‘Flower Power’ exhibition with new works from the artist Dagmar Adamski, who for many years now has earned many fans and collectors here on Mallorca (further info part 3 Galería de Arte Minkner). Minkner & Partner are looking forward to greeting many our readers of our Newsletter to these events.

 

2. Mallorca – Construction, Economy laws and taxes

 

(1) Construction / Investment

 

Palma Congress Palace handed over to Melia; Opening on 1st April

 

Melia group have officially taken over the management of the Congress Palace and its adjoining hotel and announced its opening on 1st April. The board of directors of the management company announced that Palmas Congress Palace would be the best in the entire Mediterranean region. Following a low key opening the first grand event will take place in October 2017 at the same time as an event organized by Mercedes Benz. Simultaneously Melia plans to organize concerts and art exhibitions in order to present the Palacio de Congress to the Mallorquins and local residents.

 

Playa de Palma: No Go for the PALMA SPRINGSshopping centre

 

The property developer Unibal Rodamco Spain S.L. has suffered a damaging defeat. Spain’s Supreme Court of has upheld the decision of the Balearic government to refuse approval of the planned PALMA SPRINGS shopping centre. The negative decision was essentially based on later changes to the original project and the lack of access to the shopping centre. Unibail Rodamco must therefore do more homework. The project provides for a shopping centre with 200 retail outlets and a commercial space of 75,000 m², twelve cinemas and 3,700 parking spaces. The investment volume is estimated at 225 million euros.

 

Inca: Renovation work will be resumed on Inca’s theatre after years of interruption

 

Inca’s theatre can look back on a 100-year history. However, the last renovation work took place in 1945. Inca’s local authorities took charge of the theatre in 1999. Renovation work was discontinued as of 2014 following a dispute that arose between the commissioned construction company and Inca town hall, which has not been settled to date. The renovation work is now to be resumed after the European Regional Development Fund has promised 3.1 million euros. Reopening is scheduled to take place in autumn 2019, according to the schedule of Inca City Hall.

 

(2) Economy

 

Balearics- Economy: 2017 the strongest growth in the economy since the last 16 years

 

The Balearic government has presented last year's economic data. The economy of the Balearic Islands obtained a growth of 4.1% in 2016. This is the strongest growth in 16 years. The growth of the individual industries varies: the customer service sector grew by 4.3%, the construction sector by 3.5% by industry by 2.6% and agriculture by 2.5%. The announced Brexit so far has no effect on the Balearic economy. For 2017 bookings from the UK are in line with those of 2016. For 2017, the Balearic government forecasts economic growth of 3.6%.

 

Banks I: Banks saving funds FROB (Fund for Orderly Bank Restructuring) merges Bankia and BMN

 

During the banking crisis in 2010 the banks Sa Nostra, Caja Murcia, Caja Granada and Caja Penedes were merged and given the new name BMN (Banca Mare Nostrum). The merger process is currently ongoing: BMN is now to be integrated into BANKIA. Industry experts smile: Two wrongs don’t make a right. In any case, the new merger process means that old bank names will disappear completely and only the BANKIA brand will survive.

 

Banks II: Sale at the BANK SAREB – 224 plots and 11 construction projects for sale

 

Bad Bank SAREB is offering 224 building plot projects and 11 construction projects with unfinished buildings for sale from its Balearic portfolio. Minkner & Partner is a partner of SAREB and has pre-checked the offered properties. These are essentially land for multi-family properties as well as commercial properties. The prices of the SAREB correspond to the current market so therefore cannot be described as "bargains". However, there is scope for negotiation.

 

Tourism I: Flight numbers in February 2017 increase of 1.6%

 

The airport authorities AENA can also report new increases at the beginning of the year. In the month of February, the number of passengers rose by 1.6% compared to the previous month. In total, Palmas Airport recorded 720,486 passengers in February 2017. The number of take-offs and landings increased year-on-year by 3.7%. For January and February 2017, AENA estimates the total passenger volume as 1.4 million passengers, an increase of 3% compared to the previous year.

 

Tourism II: The airline Norwegian will be flying 4 times a week from Palma to Munich

 

As of June 2017, Norwegian will fly from Palma to Munichfour times weekly. From 8th of June 2017 they will be flying Thursdays, Fridays, Saturdays as well as Sundays. Flying Mallorca to Munich at 7.25am with arrival in Munich at 9.40am and then from Munich to Mallorca flying at 10.20am and arriving here in Mallorca at 12.40pm. For a one-way ticket the price is 59,90euros. Norwegian Airlines will be flying from 15 European countries.

 

Tourism III: Left-wing party poopers in Palma's city administration line up against Palma's restaurateurs

 

Palma's left-wing city administration is in constant conflict with Palma's restaurateurs and the tourism industry. A year ago, they wanted to remove the terraces of the cafeterias from Palma’s Passeig Born ("the Borne belongs to the citizens and not to the restaurateurs"), which failed, however, due to the protest of the citizens. The left-wing party poopers are now working on a new regulation regarding the bar/restaurant terraces. On the one hand, it concerns opening times, on the other hand, however, the space between terrace furniture and zebra crossings, and access to public or historical buildings etc. Palma’s Restaurateurs Association has examined the new proposals and alarms are ringing: the implementation of the proposed regulation would result in the closure of 500 terraces; also, there are many jobs at stake, and the new proposed regulation does not distinguish between tourist zones and residential areas.

 

(3) The law taxes and finance

 

The Spanish property tax will be lavished in 2017

 

The matter regarding the property tax here in Spain is a never-ending story. In 2008 the property tax was suspended and then reinstated in 2011. Due to the economic crisis, they maintained the property tax with the aim of consolidating state finances. On the 2nd December 2016, the Royal decree 3/2016 stipulated that the tax on property will also be levied for 2017. However, the law provides for a renewed suspension of the tax on wealth from 1 January 2018 onwards. But that can change again according to the old Adenauer motto "What do I care about my chatter from yesterday" ......... never ending story.

 

The left-wing island council plans to intervene in the property rights for rural areas

 

Mallorca’s left wing island council is planning to intervene for property rights in rural areas. Currently land in a rural area requires a minimum size of 14,000 m² (originally it was approx. 7,000 m²)to be able to build a detached house. It is now being discussed to increase the minimum size to 21,000 m² or even 28,000 m², in order to counter the "further sprawl over the island". If then, the owners of land with a size below the new norm can no longer build, it is actually an expropriation. There are certainly a few thousand plots affected. It is also considered that a moratorium should be set up to so as to prevent an anticipated flood of new building applicationsdue to increased minimums of rural land.

As of 27th January, to 12th April 2017 the Minkner Art Gallery will exhibit works from great names of contemporary art: Elvira Bach, Joseph Beuys, Jörg Immendorff, Herbert Hundrich, A.R. Penk and Mike Steiner. The work of the artists differs in concept, technique, artistic style and statement as well as belonging to a certain type or group. The exhibition is also of special interest to young collectors, as there are some original prints which do not put too much of a strain on the young art collector’s wallet.

Dagmar ADAMSKI - „Flower Power” – modern contemporary art

 

Dagmar Adamski lives and works for many months of the year on her beautiful finca in Soller and has had many successful exhibitions and won many fans and collectors of her works. From the 13th April 2017 until 3rd June 2017 she will be exhibiting her new works in the Minkner Art Gallery in Santa Ponsa.

 

The artist says of herself: “I only do things that move me. I do not have to please and I am not vain. I am not looking for anything, I find things in excesses. I like a lot of things that do not cost anything: the light, the water, the earth. I closed my painting school in 2006. For more than 20 years it was for myself, for children and for adults, a great playing field. It was super!! Nowadays I spend a lot of time on Mallorca. The olives, the figs, the almonds, lemons and oranges, the pilgrimages, the wild goats, the sea with all its glory, this is all luck!! I criticize myself and what I do and I am even more critical with my students. I paint to heal myself; I write texts to protect myself. I do not want to be part of the destruction and yet I find myself sitting in the middle.”

CONSTANTIN RAHMFELD - Photography - “fiestas on Mallorca” - kings, devils, giants, penitents, and the magic of the fire

 

The Minkner art gallery is holding, for the first time, an exhibition of photographic art work by the young photographic artist, Constantin Rahmfeld. There are two reasons, the first one being, that photography has been recognised as art in the artistic world and the second reason being that Constantin Rahmfeld has worked for Minkner & Partner for the last eight years, and we think that his work should be introduced into a wider circle.

 

Mallorca is the island of “fiestas”! Nearly every local village has its own patron saint and fiestas are held in their honour. On these mystical, bustling and happy occasions, Constantin Rahmfeld loves to capture the special moments with his camera. The photographs for this Exhibition were taken on such occasions, where only the camera and the photographer hold the moment, forever. Whilst looking through the photographs a quote from Friedrich Dürrenmatt comes to mind:“Anyone can take a photograph. Even a machine. But not everyone can observe. Photography is only art when the artist portrays it correctly. Observation is an elementary poetic process. The reality must be formed, to be brought to life.”

As from the 14th of March, Sculptures from Miguel Saraste on the Promendade of Cala Ratjada

 

On the large roundabout on the motorway to Manacor by the El Cruce restaurant, for the last several years art lovers have been able to admire large-scale sculptures by the Spanish artist Miguel Sarasate. Since March 14th 2017, the artist has been working on the promenade of Cala Ratjada. The outdoor exhibition is called "Ballant amb les ondes" - dancing with the waves. Perhaps, it’s a good reason for a trip to the east coast of the island.

From 30th of March until 2nd April 2017 a sculpting course will be held at the Finca Son Baulo with Norbert Jäger. (one week-end course and a one week course). The famous artist Norbert Jäger is internationally well known too: Turkey, in the USA, in Italy, Spain as well as in Denmark. The courses that he teaches are held in Italy, Germany and Mallorca. He has commentated films such as Michelangelo and Camille Claudel. On the last evening, a small inauguration with tapas and will be held. On the 30.03.2017 -02.04.2017, sculptor courses with Norbert Jäger.

„Paintings from the Exhibition „ – Prof Wolfgang Seifen (Wings) Piano improvisations of the paintings from the artist Wilfried Lachermair

 

In 1874 the modest Mussorgski interpreted the paintings and drawings of his friend and artist Victor Hartmann. Mussorgsky's piano cycle "Pictures of an exhibition" is a sample of the music program. For the event on the 8thof April the artists Prof. Wolfgang Seifen and Wilfried Lachermair had prepared 7 pictures (mostly multimedia works/ pieces) for the event. Prof. Seifen improvises sound sequences, which are not prepared beforehand, but arise in the execution itself. The musical sounds arise from the inspiration of spontaneous ideas. This promises to be an exciting evening of music and art.

 

Prof. Wolfgang Seifen:

He has been a professor of improvisation and lithurgical organ at the University of the Arts in Berlin since October 2000. Since 1976 he has been recognised worldwide as a church musician and organist. His professional career: organist at the Papal Marienbasilika zu Kevelaer (Seifert organ with 128 registers). 1989 - 1992 Director of the organ class for improvisation and organ playing at the Academy of Music and Performing Arts in Stuttgart. From 1992 - 2000 he worked in the same position at the Robert-Schumann-Hochschule (High School) in Düsseldorf. In 1995 he was appointed as honorary professor. Since 2000, he has held the already mentioned professorship in Berlin. In 2004 he was appointed as head organist at the Kaiser-Wilhelm-Gedächtniskirche in Berlin. In addition to extensive concert activity throughout the European region, as well as in the USA and Japan, he is a juror for numerous international competitions as well as a guest lectureer for improvisation at international festivals and academies.

 

Winfried Lachemair:

After finishing his apprenticeship as gilder and conservator, and his university degree in interior design as well as architecture he concentrated on colors and forms in his paintings. Lachermair experiments in his pictures with many variations of the artistic materials. His pieces of art do not represent stories - they are the mood and the statement of the poise of the individual observer. Lachermair lives and works in the charming artists' town of S'Arraco near to Andratx. (1) Construction / Investment

 

Palma: The extension and renovation of the nursing clinic „ Son Dureta“

 

Theformer hospital Son Dureta has been vacant since 2010. Now, President Francina Amengol has presented a new concept of the use of it: with an investment of 119 million euros, the former hospital will be converted into a nursing clinic. There will be 450 hospital beds for chronically ill patients as well as a retirement home with 120 beds. The former pediatric center is going to be demolished and new buildings constructed. Tenders are due to be completed later this year; Construction work is scheduled to start in 2018.

 

Esporles: The manor house Sa Granja is going to be sold

 

500 years of history are presented in an open-air museum on the ancient estate of Sa Granja near Esporles: land, forest farming, as they all have been practiced there for centuries, partially extinct trades as such (weavers, carpenters, pharmacists, and perfume manufacturers) as well as the mallorcan nobility lived here 500 years ago. All this is soon to be a thing of the past: Sa Granja is for sale - for 17 million euros. Owner Cristobal Segui points out to his long-standing dispute with the Balearic government: while similar properties are maintained or supported by the government, he has to pay restoration and maintenance from his own pocket. This is an intolerable distortion of competition, which he does not intend to continue with.

 

Son Severa: The holiday resort is cleaning itself up

 

Son Servera, the municipality along Mallorca’s east coast is cleaning up. Hoteliers, Restauranteurs and in particular, the municipal administration are using the low season to "clean up" parts of the municipality with an investment of 1.5 million euros. In Cala Bona, the promenade "Paseo Maritimo" is going to be improved. Cala Millor is given a new health center, and in Costa de los Pins the viewing platform is going to be modernized, so that it is accessible to the tourists for the beginning of the season.

 

(2) Economy

 

Tourism I: Balearic Island is an attractive attraction at the ITB in Berlin

The International Tourism exhibition ITB will take place in Berlin from 8th - 12th March 2017. The Balearic Islands are again represented with an attractive stand at the exhibition. Here you will be able to find extensive information about the Balearic Islands and also take samples of islands products. Interesting: This year, not only will they be promoting the summer season but also "Mallorca in winter". Mallorca will once again be the most popular destination for Germans this year. In July alone, there will be 3,800 flights to Mallorca and the neighboring islands from 22 German airports.

 

Tourism II: Hotels in the Balearic Islands accounted for almost 40% in January 2017

The hotels of the Balearic Islands were occupied almost by 40% in January 2017 had a total of 225,500 occupancy. This is an increase of 0.6% compared to the previous year. The efforts to revive the off season, therefore, yield only tentative fruits. Better is the hotel utilization in January Spain-wide - there was an increase of 3.5%, as the Spanish Institute of Statistics INE announced. However, hotel prices have also increased. The average overnight cost in January 2017 was 79 €. This is 7% more than in the same month of the previous year.

 

Tourism III: Eurowings is expanding is premises. You can now book your package holidays.

 

The airline Eurowings has expanded its business premises from March 6th 2017 and now also offers packages holidays. In Mallorca, the new company "Eurowings Holidays" already has 400 hotels under contract. The process runs through the experienced tour operator Tropo from Hamburg. With their new concept, Eurowings-Holidays hopes to establish itself in the segment of high-quality low-cost package trips, like Rynair Holidays. As part of the expansion a marketing strategy was put together to advertise in the month of March on the TV channels ProSieben Sat1 Group.

 

(3) The law taxes and finance

 

Holiday rentals: From Palmas 6.000 holiday rentals that are offered only 302 are registered

 

There have been discussions on the revision of the Tourism law, regarding a special commission of the Balearic Government has the number of holiday accommodation offered on the Internet in Palma and its legality. It has also been found that only 6,000 apartments and houses are registered, ie only 5 %. As a result, the tax authorities lost considerable amounts of tourism tax and income tax. A task force is now to be set up to uncover these tax offenders.

CONSTANTIN RAHMFELD - Photography - “fiestas on Mallorca” - kings, devils, giants, penitents, and the magic of the fire

 

The Minkner art gallery is holding, for the first time, an exhibition of photographic art work by the young photographic artist, Constantin Rahmfeld. There are two reasons, the first one being, that photography has been recognised as art in the artistic world and the second reason being that Constantin Rahmfeld has worked for Minkner & Partner for the last eight years, and we think that his work should be introduced into a wider circle.

 

Mallorca is the island of “fiestas”! Nearly every local village has its own patron saint and fiestas are held in their honour. On these mystical, bustling and happy occasions, Constantin Rahmfeld loves to capture the special moments with his camera. The photographs for this Exhibition were taken on such occasions, where only the camera and the photographer hold the moment, forever. Whilst looking through the photographs a quote from Friedrich Dürrenmatt comes to mind:“Anyone can take a photograph. Even a machine. But not everyone can observe. Photography is only art when the artist portrays it correctly. Observation is an elementary poetic process. The reality must be formed, to be brought to life.”

1. News from Minkner & Partner

 

MALLORCAS TRAUMIMMOBILIEN – PTO. ANDRATX SPECIAL

 

On the occasion of the opening for our new offices on the harbour promenade in Puerto Andratx, Minkner & Partner is publishing a special edition of our in-house newspaper “TRAUMIMMOBILIEN” which will be issued as a supplement in MALLORCA MAGAZIN as well as MALLORCA ZEITUNG on 23rd of March.  Whoever hasn’t already bought it has until the 1st of March to do so.  The newspaper is also available online at www.minkner.com

2. Mallorca – Construction, Economy laws and taxes

 

(1) Construction / Investment

 

Palma Cappuccino – Group buys town house in the Calle Protectora

 

The Cappuccino group (cafés, restaurants, hotels) has purchased, from the bad bank SAREB, an old building in Palma in the Calle Protectora.  The building which was built in 1869 has been vacant for numerous years;the present façade was designed by the architect Gaspar Benazar in 1928. Throughout its lifetime, the building has had various uses; firstly, as the head office of an accident insurance cooperative, later a cinema and a place for social events, then by the local authorities and latterly as a hairdresser, a gym and squash courts. The building has a constructed area of 2,700 m². The price of the current purchase is not known; however, it was valued at € 6 million 10 2013. To date the plans of the Cappuccino Group for future use of the building are not known.

 

Palma: German investor purchases ‘Casa Roca ‘and is to convert it into a city hotel

 

Many traditional shops in Palma's old town have had to close, due to the fact that old properties need to be demolished or rehabilitated. The popular Cafe Lirico at the Borne was also affected, which had to close recently. Now the "Casa Roca" has closed in Palmas Carrer Hostal - a stationery shop, which had been open for the past 167-years. The reason why it had to close wasn’t because of sale to investors, but the fact that no successor was found for the shop. The building was sold to a German investor who wants to convert it into a city hotel.

 

Palma: Restoration work at the fortress of Sant Carles

 

Palmas most important defense was the fortress San Carles (Porto Pi). It was built in the 17th century and served as a defense against pirate attacks. At times the complex was a military prison; today it is a military museum. The building was damaged in 1890 to make room for larger guns. Further damage was caused by adverse weather conditions on this part of the coast. Now the foundation Fundatur has provided an amount of €350,000 for the restoration of the fortress.

 

Llucmayor – Capocorb Vell: Excavation site should be repaired

 

Llucmajor twon hall has decided to restore the Capocorb Vell site, which has been neglected in the past years, and to establish it as a tourist attraction. The first excavation was carried out in Capocorb Vella 100 year ago, A talaoitic settlement with 30 dwellings from approx. 900 BC was found. In a second phase the site will be signposted and an information center built.

 

Cala d`Or: Hotel Corfu + Skorpios = Alua Soul Mallorca Resort

 

The hoteliers of Cala d`Or also use the winter months to renovate their hotels. This is how the new Hotel Alua Soul Mallorca Resort in the bay of Cala Egos has evolved, as it is a combination of the existing 3 star hotels Corfu and Skorpios, which will have 4 stars in the future. The investment volume is stated as 1.3 million euros. 70 new jobs will be created in the new hotel. Until now, the old hotels were run as family hotels; in the future the Alua Soul Mallorca Resort will be reserved for adults only.

 

(2) Economy

 

Solar Energy: 32.100 households are going to be provided from the industrials solar panel roof tops

 

The association of business enterprises based in Palma’s industrial area, have commissioned a survey, the results of have now been submitted. According to this, 1,400 rooves with a total area of 50 hectares could be equipped with solar cells in the Son Castello and Can Valero business areas, which could then supply energy for 32,100 households. The association will now enter into individual discussions with its members in order to calculate the respective self- consumption and the amount of possible feed-in into the public network.

 

Airlines: Eurowings is going to be expanding and is going to employ 100 people!!

 

In the context of the lease between Air berlin and Lufthansa, Lufthansa’s subsidiary Eurowings is going to be expanding. As of May 2017, Palmas airport Son San Joan is going to be their main base, and for this reason they will be employing 100 new staff. Eurowings will be flying from the following airports: Berlin- Tegel, Bremen Dortmund, Dresden, Friedrichshafen, Hamburg, Hannover, Kalsruhe, Köln- Bonn, Leipzig, München, Münster, Nürnberg, Paderborn, Saarbrücken, Stutgart and Sylt.

 

(3) The law taxes and finance

 

European Commission urges Spain to take a decision on the "Modelo 720"

 

Since 2012, the controversial tax declaration form "Modelo 720" exists for those persons who have their tax domicile in Spain and which they must use to declare any foreign assets, bank accounts or real estate and other any assets of more than € 50,000. In the opinion of tax experts, this requirement of the Spanish tax authorities is in numerous ways contrary to higher-ranking EU law. The European Commission has already initiated infringement proceedings against Spain at the request of lawyer Alejandro del Campo. Now the European Commission requested that Spain change the rules on the disclosure of foreign assets within two months. Should Spain not comply within this period, it may be brought before the European Court of Justice.

 

Valldemossa town hall has to pay 7.5 million euros for the expropriation of a 3,000 m² site

 

The Spanish Constitution guarantees and protects property. Many politicians do not seem to know this. At present the Balearic courts have to deal with a variety of proceedings, the subject of which is e.g. reassignment of building land in green zones without compensation. After more than 20 years (!), a process of a "former" landowner from the municipality of Valldemossa has now been legally resolved. In 1995, the municipality had "recovered" the plaintiff's 3,000 m² property without compensation and has now been sentenced by the court to pay a compensation of 7.5 million euros (!). This is twice the annual budget of the town hall. In the next few years Valldemossa town hall will have to tighten their belts.

Since visitors to the gallery in Santa Ponsa were mostly from the Pto. Andratx to Palma region, we have decided to extend the length of the exhibition and it can now be seen in our Llucmajor office.

(1) Construction / Investment

 

Bus traffic instead of oleander: Left-wing government wants to convert the central reservation into bus lanes

 

The left-wing government has developed a plan to transform the oleander covered central reservation on motorways into lanes for buses. This is intended to make public transport faster and thus more attractive. The stretch of road from Paguera to Palma is the first in the planning to undergo the transformation. The bus lane will also be used by cars that carry at least three people. Comment: What seems to be more than an act of despair rather than traffic planning, has nothing to do with an environmentally conscious and forward-looking traffic policy, for which the left-wing government had taken up the cause.

 

Estellencs: Tunnel closed for several weeks following rock fall

 

Estellencs, in the south-west of Mallorca, can only be reached via a detour at the moment, as the tunnel between Andratx and Estellencs is closed due to the heavy rainfall of the past few weeks. Despite the danger some of the locals had attempted to drive through the tunnel, which is closed due to precautionary measures, however the entrances have now been blocked with concrete barriers. The repair and protection work will last at least until the end of February 2017.

Unemployment rate ‘only’ 14%

 

With the stabilization of the Spanish economy, the number of those employed has also risen sharply, which has had a positive effect on the unemployment figures. At the moment 530,000 people on the Balearic Islands are still without work, which corresponds to an unemployment rate of 14%. Although still very high, taking into account the fact that the unemployment rate was 25% during the crisis, this is a great improvement. The Balearics are the only region in Spain where the unemployment rate is at the same level as before the crisis. The unemployment rate in Spain is 18.6%. However, among young people between the ages of 20 and 24, the rate is still almost 40%.

 

Balearic islands ports: Record turnover of goods 2016

 

The ports of the Balearic Islands (Palma and Alcudia on Majorca, Mahon in Menorca, Eivissa in Ibiza and La Savina in Formentera) cannot only register record numbers in cruise ship tourism, but also in the area of the transport of goods and handling of cargo. In 2016 a new record was created with a turnover of 14.6 million tonnes. The port of Palma handled 9 million tonnes. The main goods are fuel and coal, building materials, food, grain and tobacco.

 

Trade: LIDL opens 17th branch in Mallorca

 

The German supermarket chain continues its European wide competition with its competitor ALDI on Mallorca. Over the next few days LIDL will open its 17th branch on Mallorca, just to the north of Palma, not far from Palma Arena. The 1,200 m² branch will employ 25 workers. The investment is quoted as 2.5 million euros. The company is continuing to focus on sustainability and states that the energy required is generated by solar panels on the roof.

 

Tourism I: Over 13 million tourists visited the Balearic Islands in 2016

 

The Spanish Institute of Statistics has now published the Tourism Report for Spain for 2016. The Balearic Islands are once again top performers, with a total of 13,011,876 visitors. This is an increase of 11.9% compared to the previous year. Cataluña received 17.9 million tourists, and the Canary Islands 13.3 million. Overall, 75.6 million foreign guests visited Spain in 2016, which is an increase of 10.3% compared to the previous year.

 

Tourism II: In 2016, tourists spent over € 13 billion

 

The Spanish Statistical Office has just published further data regarding the tourism industry in the Balearic Islands in 2016. In 2016 tourists spent 13 billion euros, 10.5% more than in 2015. Just as a reminder: In 2015 we already had an increase of 13.6% compared to 2014. Compared with 2007 (the year before the start of the crisis), the figures are impressive. At that time the tourists spent 9.23 billion euros.

 

Tourism III: Balearia has two new ferries in Italy, investment volume 200 million euros

 

The Balearia ferry company has commissioned the Italian shipyard, Cantiere Navale Visentini, to build two ferries with an investment volume of € 200 million. Liquefied gas will be used in part to operate the ferries in order to reduce the carbon dioxide emissions by more than 40 percent. The top speed will be 24 knots. Vessel data: length 186.5 m, capacity 810 guests, 2.180 running meters of cargo, 150 cars, 123 cabins and 402 seats.

Minimum interest rate: banks must return 4 - 5 billion euros to customers

 

M & P newsletter has already reported on the prohibitive decision of the ECJ of 21st December 2016 on the unacceptable minimum interest rates in mortgage contracts. The Bank of Spain has said that they are expecting reimbursement claims of affected bank customers between 4 and 5 billion euros. The banks are currently making corresponding provisions. CONSTANTIN RAHMFELD - Photography - “fiestas on Mallorca” - kings, devils, giants, penitents, and the magic of the fire

 

The Minkner art gallery is holding, for the first time, an exhibition of photographic art work by the young photographic artist, Constantin Rahmfeld. There are two reasons, the first one being, that photography has been recognised as art in the artistic world and the second reason being that Constantin Rahmfeld has worked for Minkner & Partner for the last eight years, and we think that his work should be introduced into a wider circle.

 

Mallorca is the island of “fiestas”! Nearly every local village has its own patron saint and fiestas are held in their honour. On these mystical, bustling and happy occasions, Constantin Rahmfeld loves to capture the special moments with his camera. The photographs for this Exhibition were taken on such occasions, where only the camera and the photographer hold the moment, forever. Whilst looking through the photographs a quote from Friedrich Dürrenmatt comes to mind:“Anyone can take a photograph. Even a machine. But not everyone can observe. Minkner and Partner opened their new offices in Pto Andratx on the harbour promenade at the start of the year.

In 2016 Real Estate prices rose by 30, 2% on the Balearics

 

When the major real estate companies in the Balearics reported an annual increase in real estate sales between 20% and 30% over the last three years, they encountered disbelief. The latest figures from the Spanish statistical institute INE confirm the statements made by the various estate agents. In 2016, 12,712 properties were sold in the Balearic Islands. This is an increase of 30.2% compared to the previous year. This means that the Balearic Islands are far above the Spanish average of 17.3%. Prices also rose sharply in 2016, with an average of 7.5% compared to the previous year. For 2017, a further price increase of 6% is expected.

 

2. Mallorca – Construction, Economy laws and taxes

 

(1) Construction / Investment

 

Palma: Investment of 16,3 Million euros in cruise tourism

 

The Balearic Islands’ port authority intends to spend a total of 16.3 million euros this year on conversion and renovation work to Palma's port. The bulk of these costs are dedicated to the infrastructure of cruise tourism. On the west quay, pier 6 is to be extended by adding several mooring points, in addition to which investments will made in fire protection systems. Based on previous planning, the Port Authority is assuming that this year 560 cruise ships will arrive into Palma's port bringing 1.63 million passengers to Mallorca.

 

Palma’s Can Domenge - first phase of new housing development with 40 Apartments already completed

 

The Can Domenge urbanisation near Palma Arena has been a talking point for a long time because of the massive corruption scandal: the former president of the island council, Munar, received a large amount of money for the granting of licenses for which she is currently serving a long prison sentence. Now a housing development comprising of 280 apartments is being builtin Can Domenge. The first construction phase of 40 apartments has already been completed, one third of which has already been sold. The complex will also have a Lidl on site as well as a fast food restaurant.

 

Palma: New pedestrian area in Santa Catalina

 

Tourists and night owls will be delighted; residents will have with mixed feelings: A new pedestrian area is to be constructed in the trendy area of Santa Catalina.  The Carrer Mir, between the Carrer Sant Magi and the Carrer Bayarte, is to be closed to traffic. Carrer Sant Magi and Carrer Vicari Antoni Marimon are currently being paved, the cost of which is estimated as being €140,000.

 

Palma: A glimmer of hope for the change of usage of the Pueblo Español

 

The Pueblo Español has unfortunately never brought its owners any luck and even less luck concerning a positive bank balance! For some time now a change of plan for the use of the area has been under discussion, which could lead to the creation of a luxury apartment complex on the site.  In the meantime, Palma's municipal government has declared that it has no fundamental reservations against a re-assignment, but some technical studies on the re-allocation of the site would have to be made. Also, residents who fear its use for tourism rentalwant to express their concerns..

 

Coll den Rabassa: Island council wants to build a bridge over the motorway

 

The motorway exit of Coll d`en Rabassa, has been inundated with traffic since the opening of the FAN shopping centre.  The island council has now decided to demolish the existing old bridge and build a new bridge over the motorway; this is because the existing older bridge is not suitable for expansion and the creation of new additional lanes. The new bridge will have a lane for the FAN shopping centre and another for the entrance to the second ring road to Palma.

 

(2) Economy

 

Tourism I: Swiss airline BELAIR remains on the ground

 

Following the departure of Air Berlin from Mallorca, several competitors will use their flight routes in the future. The cards have been dealt. The restructuring of Air Berlin seems to have acquired another victim: A subsidiary of Air Berlin, the demise of the Swiss carrier BELAIR, which up to now operated the Majorca to Zurich route, seems to be in the offing. 295 employees are expected to lose their jobs. It is expected that the BELAIR routes will be operated by Niki and Tuifly.

 

Tourism II: Congress Palace operator MELIA plans to hire 200 new employees

 

The management company of the Congress Palace and the adjoining congress hotel, MELIA HOTELS INTERNATIONAL wants to have the complex, (which has devoured construction costs of 119 million euros,) up and running as of 1st April 2017. At the moment they are looking for new employees and MELIA will create 200 new jobsin total. The project was also presented at the tourism fair FITUR in Madrid and for this reason MELIA Chairman Gabriel Escarrer and Palma’s Mayor Jose Hila travelled to Madrid.

 

Tourism III: MELIA will manage the Tryp hotel in Santa Ponsa

 

The hotel group MELIA is now also active in the southwest of the island in the coastal resort of Santa Ponsa where they are currently building the Hotel Santa Ponsa Pins in Avenida Rey Jaime I. The hotel has 60 rooms, a conference room, fitness room, bar and restaurant as well as a pool. However, MELIA will only be a franchisee for the new Tryp hotel. Although MELIA owned the Tryp brand up to 2010, it sold it to the Wyndham Group in 2010.

 

Harvest and wine production for 2016 in the Balearic Islands

 

Although the wine producing area in the Balearics decreased by 2% last year, winegrowers can still claim a record harvest and production. A total of 60,013 hectolitres were produced, which is an increase of 10.2% compared to the previous year's production. There are currently six protected areas in Mallorca: Balears, Majorca, Serra de Tramuntana, Eivissa, Menorca and Formentera.

 

(3) The law taxes and finance

 

Over 300 objections to the law on vacation rental

 

An important issue in the electoral programme of the left-wing government was the announcement of a law that would regulate holiday rental. The recently introduced draft does not appear to be a big hit.. On the one hand, the island council announced that it would take about 2 years to draft the implementation rules (at which time the present government will no longer be in control), and secondly because more than 300 objections are currently being raised against the draft law. Strong protests, of course, come from the hoteliers, who want to defend themselves against private competition and their arguments include tax evasion and securing jobs in the tourism industry. Private owners have criticised the planned quotas and ceilings for the number of licenses to be awarded.

 

The results of an empirical survey by the opinion research institute Gadeso have just been published. 58% argue against and only 29% in favour of allowing living space to be used for vacation rental. In the city of ​​Palma, 68% are opposed to it. The main argument: the renting of apartments to holidaymakers makes it difficult for residents and workers to access apartments in the already very tight property market in Palma. The hoteliers, who voted against the legalisation of the holiday rental of apartments, will be pleased with the results of the survey.

 

The Balearic government wants to make a large area of Es Trenc as a nature reserve

 

The Balearic government wants to convert a large area around the beach of Es Trenc into a nature reserve. A corresponding law has now been presented to Parliament. 2,226 hectares marine surface and 1,448 hectares of land area are affected. The number of parking spaces is to be limited to 1,500. In addition, a bus transfer is to be created. Although in principle these plans are supported by all parties, there are protests from the Campos town hall and some business people who will also be affected. The issue of parking management has not yet been satisfactorily resolved.

As one would expect from a professional company, Minkner & Partner have opened new premises in Pto. Andratx, in the Avda Mateo Bosch 8, right on time. This was a “low key” opening as the official opening will take place on 24th of February. The new premises will be run by our sales manager, Matthias Neumann who has a degree in business studies, and his team: Luis Pitarch, Renato Cerullo, Oscar Chuctaya, Maria Schmidt, Serafima Joel and Anjela Grinyuk.  The Andratx team are supported by Marvin Bonitz, Sales Director of Minkner & Partner, who will also be an important contact for the regional property developers.

 

The new opening is accompanied by a large marketing campaign for real estate located in Pto. Andratx and the surrounding area. On the 23rd February there will be a special edition of MALLORCAS TRAUMIMMOBILIEN with over 50.000 copies of the magazine dedicated solely to the Andratx region. 2. Mallorca – Construction, Economy laws and taxes

 

(1) Construction / Investment

 

Delayed application processing in the town halls, prevented 113 million investments.  Laziness or intention?

 

The President of the Hotel Association of the Balearic Islands, Inmaculada Benito, has launched a strong attack against the Balearic Government and the responsible officials in the municipal town halls. According to her information, planned investments of 113 million euros will be suspended and postponed until the winter of 2017/2018. The reason for this is that the construction departments of some town halls have taken up to 18 months to issue building licences, while the conservative government took approximately 6 months to issue the necessary licences. The town halls of Palma and Calvia were particularly slow. The consequence is that numerous construction contracts could not be granted, which  leads to a considerable economic loss. Benito suggests that she is not sure whether this is due to laziness in Calvia and Palma town halls or whether the delay is based on intent, because the left wing government has so far shown "lack of sensitivity to the needs of the tourism industry".

 

16 Million Euros has been invested by the Islands council for the development of cycling pathways and roads

 

Mallorca's island council is worried about the security of cyclists, who also form an important part of tourism on Mallorca. For this reason, they have set aside 16 million euros in the new budget for this project. These means are intended to improve cycle paths and roads which are constantly used by cyclists, especially in the Tramuntana Mountains. Furthermore, on some of the country roads, the hard shoulder will be broadened. On numerous roads the grip of the asphalt is to be improved, which should benefit not only cyclists, but also drivers. 

 

Pto. Andratx: Calle Levante is to be extended to relieve the road of the harbour promenade

 

During the summer season the harbour of Pto. Andratx is very busywith traffic along the seafront. Waiters, who need to cross the road to serve clients on the terrace waterfront, risk their lives on a daily basis.  The governmental alliance of PP and Pi, which is currently in charge in the town hall of Andratx, now want to put an end to this by lengthening Calle Levante to create direct access to the urbanization of La Mola, Valleluz and Cala Marmacen. Construction work is scheduled to start in mid-January 2017 and will be completed by the start of the summer season. An initial budget of € 700,000 is provided.

 

Calvias town hall is planning a Skate- Park

 

Calvia town hall is planning to build a skate park on a 1,200 m² plot near Galatzo, the urbanization close to the windmill at the exit to Calvia, Santa Ponsa and Andratx. This would make Calvia a centre for international skate boarders. The idea was inspired by the fact that skateboarding will become an Olympic discipline as of 2020. The necessary investment is € 350,000.  The Conservative as well as the Liberal party have criticised stating that such a facility is oversized for the municipality. It is also doubtful that Calvias attractiveness will be increased.

 

Palma:The Sa Riera Stream  

 

Already one year ago, the city of Palma presented a project to build a city park with a surface area of 34,000 m² close to the Avenidas, to act as a "green area” for Palma. This project has now been incorporated into a larger one, including Sa Riera which will also form part of this “green corridor.” The project has now been submitted to the EU under the subvention programme ‘Life’ which is intended to make a small contribution to climate changes. The planting of 4,000 trees is intended to compensate for carbon dioxide emissions. The total investment is quoted as being 3.8 million euros, of which the city is to pay 1.3 million euros and to finance the rest from EU funds.

 

Palma- Inca: Another motorway section to have 6 lanes

 

Construction work on a section of the motorway between Palma and Inca has begun. It is a section of approx. 6 km in the area of Festival Park in Marratxi, which is to be increased to 6 lanes. Construction work is expected to last three to six months and will cost 2.7 million euros. Since the construction work is done at night, the traffic is redirected during these hours.

 

(2) Economy

 

Tourism I:In 2016 there were 13 million tourists visiting the Balearics

 

So far, only the figures for the period January to November 2016 have been made available. During this period, 12.9 million tourists visited the Balearic Islands. This is 12% more than in the same period of the previous year. In the 11 months of 2016 Spain had 71.6 million visitors. This is 10.1% more than in 2015.  For the month of December booking numbers were high for the Balearics; so the 13 million mark will definitely be exceeded.

 

Tourism II: “Low cost Airlines” brought 5, 8 million guests to the Balearic Islands

 

With Air Berlins final departure from Mallorca, the market shares among the airlines were already redistributed in 2016. In the months of January to November 2016 the Balearic Islands handled 12.9 million passengers, an increase of 12.9% compared to 2015. 5.8 million Passengers used low-cost airlines such as Ryanair, Vueling or Easyjet. This is an increase of 18.9% compared to the previous year. Experts believe that in 2017 more passengers will use low-cost airlines rather than traditional airlines.

 

Tourism III: The Gran Hotel in Soller has a new owner. Gelabert is staying on Board of Directors

 

The Gran Hotel Soller has a new owner. A French company “Group Sermeta” has bought the 5-star hotel for 10 million euros, said Andreu Gelabert, the former owner. However, Gelabert remains the company's managing director. Sermeta intends to expand the existing hotel and also wants to purchase other hotels on Mallorca. The employment contracts were honoured. The emblematic building dates back to 1880 and has been used as a hotel since 1960. Gelabert bought the property and opened in 2004 the Gran Hotel Soller as the first 5 star hotel of Soller.

 

Wine production 2016: A record year despite unhelpful climate conditions 

 

2016 was a record year for Mallorcan wine growers and bodegas. Despite unfavorable climatic conditions, the balance sheet shows a production of more than 6 million litres. This means that production was 10.2% higher than the previous year. Per hectare, winegrowers recorded a yield of 5,897 kg of grapes. Almost half of the grapes (44.5%) were processed into red wine, 30.5% to white wine and 25% to rosé wine. Over the past ten years wine production has increased by 25%.

 

(3) The law taxes and finance

 

Corruption is indiscriminate – the shameful example of the President of the Balearic Parliament Xelo Huertas (Podemos)

 

My grandmother never trusted any politician ... “put them all in one sack and hit it hard, you will always hit the right one!“  How right she was! This was confirmed by the example of the current President of the Balearic Parlament, Xelo Huertas.  Podemos, the left popular party, gained power by promising to end corruption in Spain.  Only a short time in power and it was discovered that Podemos was involved in a well-known scandal!  Parliament President Huertas had used her position to encourage, push and sign a questionable contract between the Balearic Parliament and a pharmaceutical company which belongs to a Podemos politician. The lady in question was thrown out of the party when the deal came to light.  Huertas however, refuses to give up her position and mandate as Parliament President.  “Corruption is the pathway which runs parallel to the chain of command“.

 

Illegal Holiday Rentals

 

The left government has announced that they will adopt a new holiday rental law in April 2017.  The timetable will be difficult to meet as the islands council has announced a long trial period.  Biel Barcelo the Minister for Tourism announced that the government wanted to take action against illegal holiday rentals even before the law came into effect. It was recommended to diligently check all offers of holiday lets in the internet, as many of these holiday rentals offered had not been registered with the authorities.  Such offers would, on one hand, deprive or render unjustifiably expensive valuable housing for the home market, and on the other hand a considerable loss of income and tourism tax for the state.  Biel said that the Government currently want removed some 31.000 illegally offered apartments. There is also the option of obliging websites to advertise only those properties that are registered with the authorities.

 

The European Court of Justice will collect minimum interest rates. Banks must reimburse interest.

 

In a judgment of 21st December 2016 (C-154/15, C-307/15 and C-308/15) the European High Court of Justice ruled against the Spanish banks. The court declared that a clause in mortgage contracts which provided for a minimum interest rate, even if the lead rate was significantly lower,wasunlawful. In summary, the repayment claims of the bank customers will amount to a few hundred million euros.  Also in the Balearics many thousands of bank customers will be affected.  Consumer protection associations are assuming thatbecause of the clear legal situation, banks will try to reach out of court settlements.

CONSTANTIN RAHMFELD - Photography - “fiestas on Mallorca” - kings, devils, giants, penitents, and the magic of the fire

 

The Minkner art gallery is holding, for the first time, an exhibition of photographic art work by the young photographic artist, Constantin Rahmfeld. There are two reasons, the first one being, that photography has been recognised as art in the artistic world and the second reason being that Constantin Rahmfeld has worked for Minkner & Partner for the last eight years, and we think that his work should be introduced into a wider circle.

 

Mallorca is the island of “fiestas”! Nearly every local village has its own patron saint and fiestas are held in their honour. On these mystical, bustling and happy occasions, Constantin Rahmfeld loves to capture the special moments with his camera. The photographs for this Exhibition were taken on such occasions, where only the camera and the photographer hold the moment, forever. Whilst looking through the photographs a quote from Friedrich Dürrenmatt comes to mind:“Anyone can take a photograph. Even a machine. But not everyone can observe. Photography is only art when the artist portrays it correctly. Observation is an elementary poetic process. The reality must be formed, to be brought to life.”

Jürgen Wölke - RETROSPECTIVE "assemblages - The world in miniature"

 

The artist Prof. Jürgen Wölke died in 2010. His main body of work was assemblages - patio-plastic material images reflecting what he calls "the world in miniature“. Large-scale works are located, for example, in New York's airport and at Leipzig Central Station as well as in numerous private collections. The Berlin Senate have presented numerous state guests with a Wölke assemblage as a gift.

 

Wölkes most common motives were those of his time battered facades of the German capital, small traditional shops, the Berlin corner pub and scenes from the lives of ordinary people. This work Wölke continued on Mallorca. Again, he found in the capital Palma facades and subjects worth replicating, and he created sensible environmental studies of documentary value. The largest German private collection of Wölke’s work is owned by the bankrupt entrepreneurs Schlecker and was dissolved as a result of the insolvency process.

 

Edith and Lutz Minkner were the main promoters of the artist and part of their Wölke collection is on show in Llucmajor.

As of 28th December and throughout the following days the “Ella International Lesbian Festival” took place on Mallorca. The Festival’s theme was that of the woman in today’s modern business environment, especially the role of successful, lesbian women in executive positions of employment. 

A press announcement stated “On Friday there will be numerous and diverse events on offer: yoga, meditation, gallery visits, visits to animal shelters, as well as fitness courses on the beach“ – are these the correct themes for the modern business woman? We too shall take a short Christmas break. The next issue of our newsletter will be published on the 13th of January and then as usual every second Friday. We are pleased to announce that in 2017 it will be the 10th anniversary of our M & P newsletter.

 

Minkner & Partner will be opening its new frontline office in Pto. Andratx at the turn of the year

 

Whilst you are reading this newsletter, the workmen are putting the finishing touches to the new office premises of Minkner & Partner in Puerto Andratx. The removal men are already loading and unloading all of the office furniture. At the turn of the year 2016/ 2017 our new frontline premises, located opposite the fish market ‘La Lonja’, in Avenida Mateo Bosch 11, will be opening its doors. The multi-lingual team has been increased, and under the management of sales director Matthias Neumann, have been in training for the past few weeks and look forward to new, exciting business challenges. Mallorca’s Properties: Price increases for existing properties in the third quarter of 2016 of 6.1 %

 

The Spanish Institute of Statistics (INE) has published its latest figures for property prices in Spain. The statistics show that real estate prices in the Balearics rose by 5.4 % in the third quarter of 2016 compared to the same period of the previous year. In Spain, the price increase was an average of 4 %. For new developments, the price increase on the Balearic Islands was slightly more moderate with 3.4 %, whereas in the case of existing real estate it was 6.1 %. Since new build activity has not yet reverted to pre-crisis times, many purchasers have had to resort to existing housing, which influences the prices.

 

2. Mallorca – Construction, Economy laws and taxes

 

(1) Construction / Investment

 

Palma: Facades of buildings are placed under conservation order against advertising

 

Palma is having a spring clean and the façades of the old town are now impeccable. However, according to ARCA, the Monument Conservation Association, this is not the case throughout Palma. All over the city business premises have opened on the ground floor of old town houses and their advertising covers the historical façades. ARCA point out that all buildings in the historical old town of Palma come under conservation order and that no advertising or painting of the façades should be permitted. Only those changes which would not affect the overall appearance of the old town are likely to be approved.

 

Palma: City Palace “Can Bordoy“ is going to be converted into a Boutique - Hotel

 

In Palma’s old town a new boutique hotel is to open. The award-winning architects, Paloma Hernaiz and Jamie Oliver (OHLAB) are commissioned to convert the city palace into a boutique hotel. Originally the plan was to convert the city palace into apartments; the palace comprises a construction area of 1.000 m², as well as a courtyard and a beautiful garden. The hotel will have a restaurant that will also cater for the general public as well as hotel guests.

 

Palma: Parliament is in agreement with the expansion of the Port of El Molinar

 

For several years now, there have been discussions regarding the development of the Es Molinar port: Advocates of the expansion plan want to increase the number of moorings from 72 to 220 and the total area of the harbour to 72,000 m². On the other hand, residents and environmentalists have fiercely protested against this proposal and have received the support of the current left-wing government. The Balearic Parliament with its left-wing majority has now voted against the project, but wants to discuss and examine alternative solutions with the Spanish Construction Ministry and the Port Authority.

 

Cala Ratjada: The harbour is going to be reconstructed at a cost of 7, 6 million Euros

 

The port of Cala Ratjada is to be redeveloped and renovated with funds from the state government to the amount of 7.6 million euros and thereby the state government is fulfilling a long-standing demand from the local authorities, who had repeatedly pointed out safety shortcomings. The funds are mainly being used for the redevelopment of the port's protective dam which was expanded 50 years ago, and is leaking. As a result of this leakage, when there are high waves there is considerable danger to residents, tourists, fishermen and the local boatbuilding industry. Furthermore, the moorings are to be re-arranged and expanded. The required tenders for the project will begin in January 2017.

 

Capdepera: 2017 will see the beginning of the construction of the long planned coastal cycling path

 

For many years now the project for the coastal cycling path has been put on hold by the town hall of Capdepera. Now the necessary funds for the planning phase have been made available in the 2017 budget. The total cost will be approximately 6 million euros. The cycle path will connect the villages of Cala Ratjada, Cala Mesquida, Cala Agulla, Cala Lliteras-els-Pelats, Cala Gat, Son Moll, Pedruscada-n'Aguait-es Carregador, Font de sa Cala- Provencals and Canyamel.

 

Deia: Deia’s local authorities are planning a salt water desalination plant

 

In view of the water problems last summer, Deia’s local authorities are planning to build a sea water desalination plant. The estimated cost for this project is 1 million euros.It is intended that the revenue from the tax Ecotasa (environmental tax, tourist tax) will fund this project.

 

Meanwhile, Mallorca’s reservoirs are gradually recovering. Due to the rainfall of recent weeks, the water level is currently around 40 %, higher than in the previous year.

 

The island council is investing 30 million in Infrastructure projects

 

In the coming year, the island council will be investing 30 million euros in infrastructure. This entails a total of 244 different projects which are due to be implemented in 2017. They will focus on refurbishing buildings with a total of 47 projects, as well as the construction of roads and motorways amounting to some 56 projects, and also the elimination of hazards on streets for disabled people with a further 15 projects. Also planned are 70 energy efficiency projects and 56 water projects. In addition to the meaningfulness of these projects, the "investment of historical dimensions" will also serve to stimulate the economy.

 

(2)Economy

 

Forecast for economic growth: In 2016 = 4, 1 %, 2017 3,7 %

 

The Balearics are likely to be European champions in 2016 with regard to economic growth. The Ministry of Labour and Industry has drawn up a provisional balance sheet for 2016 and announced an economic growth rate of 4,1 % in 2016. An economic growth of 3,7 % is predicted for the Balearic Islands in 2017. Even though this is only a forecast the left Labour Minister Iago Negueruela is already thinking of how he will use it: There must be a better distribution of wealth from top to bottom. Employees should demand higher salaries. Moreover, the labour market reform carried out by the conservative central government should also be withdrawn.

 

Agricultural minister of the Balearics: Due to the economical dry period, rough losses had been made

 

In 2016 the Balearic Islands' agricultural industry was hit by heavy losses. Sales went down by half, according to the farming Association ASAJA. The olive, almond and cereal crops were particularly hard hit. For some farmers, the yield is practically zero in October and November due to the long drought and low rainfall. The Balearic Government had granted the farmers concerned tax reliefs but these are merely “a drop in the ocean".

 

Shadow economy and black money: Cash transactions between business people should be no higher than € 1.000 effective as of 1st January 2017

 

The central government is working on a draft bill, whereby as of January, 1st 2017, cash transactions among businessmen will only be allowed up to the amount of € 1,000. Up until now the limit was € 2,500. This is seen as a further step in the fight against the shadow economy and violations will be punished with severe penalties. With regards to the € 1,000 limit, only payments between private individuals or non-residents are excluded.

 

Tourism I: Foreign Tourism spent from January to October 2016 12,7 million euros on the Balearics

 

Never before in the history of tourism has the Balearics had so many visitors as this year and this means that cash registers were ringing. During the period from January to October 2016 12,7 million euros were spent in the Balearics. This is 10.5 % more than the previous year. Throughout Spain only Cataluña can quote better figures. The "average tourist" stayed seven days and spent € 1,023.

 

Tourism II: Goodbye Air Berlin

 

After almost 40 years of successful business in the tourism industry, as of summer, 2017 Air Berlin will cease operating its flights to and from Mallorca. Very sad, as Air Berlin played a large part in the success in Mallorca’s tourism. The winter flight plan as well as tickets already booked, maintain their validity. Flights to and from Mallorca will be operated by an airline which will combine Niki and Tuifly. However, the negotiations between Tui and Etihad, the major shareholder of Air Berlin, have not yet been completed. Air Berlin has already transferred its Niki shares to Etihad. The new airline is expected to have 60 aircrafts, which are to be used mainly for flights to Mallorca and the Canaries. The new company will be based in Vienna.

 

Tourism III: Germania new subsidiary in Mallorca

 

As Air Berlin is ceasing its operations and handing them over to Niki, other companies are interested in taking over the market such as Germania, who is expanding and is going to have a base here in Mallorca as of May 2017. Due to a great demand of flights to Mallorca from Germany and Switzerland, Germania has seen a gap in the market and for this reason they will be flying on a daily basis to and from Friedrichshafen, Dresden, Bremen, Münster/ Osnabrück, Zürich, Nurnberg, Erfurt, Rostock und Dortmund. Further destinations will also be included such as: Maastricht, Montpellier and Strasbourg.

 

(3) The law taxes and finance

 

The left-wing government is intervening illegally against nature conservation

 

The left-wing government is environmentally and nature-friendly. It does not, however, act according to its declared election goals. Latest example: About 3 % of the world heritage Serra de Tramuntana is under special protection. People are not allowed to enter in this area because rare animal species such as the monk vulture and the midwife toad are not to be put at risk. This 3 % are "zonas de exclusion” and are located mainly in the north of the island. Some interested persons have already tried several times to modify this protection. In 2015 the courts upheld this protection order. Now the left-wing government - the environmentalists - in an “about turn" – wish to introduce an amendment to the law that allows access to these protected areas. The Ministry of Finance and Public Administration in Madrid have said that the new law of the Balearic Islands is not only a violation of the law to protect these areas, but also a violation of the constitution. The disputed law is now to become the subject of a mediation commission between the central and Balearic governments and, if necessary, conceded.

In times of empty coffers, Mallorca’s building authorities have employed more staff and are better organized in order to hand out the necessary punishments for building violations. Anyone who builds without permission has a higher risk of being caught and punished. The owner of an agricultural plot alongside the motorway close to Arenal has suffered the consequences! He built a small 25 m² house with a pool which he planned to extend by a further 130 m² He had been refused permission in 2009, however, he disregarded this decision and carried on building. In 2013 he received instructions to demolish the house and pool and to restore it to its original state. He also received a penalty payment of € 112.000, which has been upheld in the appeal court.

The Minkner art gallery is holding, for the first time, an exhibition of photographic art work by the young photographic artist, Constantin Rahmfeld. There are two reasons, the first one being, that photography has been recognised as art in the artistic world and the second reason being that Constantin Rahmfeld has worked for Minkner & Partner for the last eight years, and we think that his work should be introduced into a wider circle.

 

Mallorca is the island of “fiestas”! Nearly every local village has its own patron saint and fiestas are held in their honour. On these mystical, bustling and happy occasions, Constantin Rahmfeld loves to capture the special moments with his camera. The photographs for this Exhibition were taken on such occasions, where only the camera and the photographer hold the moment, forever. Whilst looking through the photographs a quote from Friedrich Dürrenmatt comes to mind:

“Anyone can take a photograph. Even a machine. But not everyone can observe. Photography is only art when the artist portrays it correctly. Observation is an elementary poetic process. The reality must be formed, to be brought to life.”

ELENA GATTI and Peter Thoms - from graphic to abstract

 

One aspect of the history of painting of the 20th century is the shift from figurative representation through several development steps to a gradual abstraction whose ultimate goal was the complete disintegration of the graphic. The result is an autonomous artistic statement. The Minkner Art Gallery in Santa Ponsa offers a new collective exhibition by the artists Elena Gatti and Peter Thoms, who follow the path from graphic to abstract through their work.

 

Elena Gatti was born in 1950 in Argentina, and now lives and works in her adopted home of Mallorca. By sketchy allusions and overwriting them to evolve forms, light and shadow, and thus comes to new perspectives of objects and people. It stimulates the imagination of the viewer, creating "works for immersion".

 

Peter Thoms, awarded the Ruhr Prize for Art and Science, is a master of the game of colour and light, which he uses almost playfully to resolve the representational and abstract. From the Middle distance, itself developed from the ordered chaos arises.

Jürgen Wölke - RETROSPECTIVE "assemblages - The world in miniature"

 

The artist Prof. Jürgen Wölke died in 2010. His main body of work was assemblages - patio-plastic material images reflecting what he calls "the world in miniature“. Large-scale works are located, for example, in New York's airport and at Leipzig Central Station as well as in numerous private collections. The Berlin Senate have presented numerous state guests with a Wölke assemblage as a gift.

 

Wölkes most common motives were those of his time battered facades of the German capital, small traditional shops, the Berlin corner pub and scenes from the lives of ordinary people. This work Wölke continued on Mallorca. Again, he found in the capital Palma facades and subjects worth replicating, and he created sensible environmental studies of documentary value. The largest German private collection of Wölke’s work is owned by the bankrupt entrepreneurs Schlecker and was dissolved as a result of the insolvency process.

 

Edith and Lutz Minkner were the main promoters of the artist and part of their Wölke collection is on show in Llucmajor.

(1) Construction / Investment

 

Palma – El Terreno: Two construction projects are being carried out in 2017

 

El Terreno was one of the most sought after residential areas of Palma. Today the area is very run down:Many of the buildings are empty, only bars one next to the other and at night the area is very noisy and unsafe. Therefore, the time has come for Palma’s City council to reinvest. Two projects are planned for 2017: First of all, the Torrent del Mar Pas that runs from the small fishing harbour of Can Barbara to the Bellver Castle where they plan to create a park where you can enjoy walks as well as spend leisure time. The second project is the restoration of the swimming pool S´Aigua Dolca, which opened in 1941 and was open until the 70s. Tenders are being submitted for both projects.

 

Palma: Gesa – Empty building under conservation protection

 

The emblematic glass facade building of the Gesa Electricity Company located on the outskirts of Palma city, has stood empty for the last 15 years since Gesa moved out. Some wanted to knock down the building others wanted to have it protected under conservation laws. The conservationists won the day in 2007 as the Mallorca council put the building under conservation protection. This decision was decided, eventually, through many court procedures. Until now the building is under the conservation laws just an empty building. Ideas on how to use the building are under discussion, but so far nothing has been confirmed. The council have suggested that it could be used for cultural purposes. Without any particular concept, it has been decided to spruce up the ground floor at a cost of 15.000 €. For 2017 it is planned to invest a further 200.000 €. For what? A fiasco both politically and planning wise.

 

Calvia- Magaluf: 45 Million - Calvia Beach Resort Project construction work has begun

 

In the last days, the extensive construction work on the new Calvia Beach Resort has started. The Melia group and its partners have planto build a new 4-star hotel in which they will invest 45 million euros in. The hotel will comprise 270 rooms, various pools and terraces, restaurants as well as a shopping mall, leisure areas and gyms. The offers are to be "challenging" in the sense that they are striving to change Magaluf from a British party mile to the higher-end family holiday resort. The opening of the new hotel is planned for 2018 and 260 new jobs are to be created.

 

(2)Economy

 

Tourism I: The Golf tourism brings an annual revenue of 220 Million Euros to the Island

 

The International Golf Market (IGTM) took place on Mallorca from 14th to 17th November; it is the most important branch of golf tourism in Europe. 450 exhibitors from 55 countries and more than 100 sports journalists participated in the event. Although, the current left-wing government is highly critical of golf and is trying to prevent the construction of new golf courses whenever possible, they do welcome this event and its glamourous international guests. They are also pleased to claim the economic contribution of the golfers to the tourism business as their success. Every year, the golfers spend 220 million euros on the islands, which is relied on by the Ministry of Tourism.

 

Tourism II: Germania Airlines are opening a new subsidiary here in Palma

 

Due to the ‘turbulence’ that Air Berlin is suffering, the airline Germania plans to open a new base in Mallorca for the summer of 2017. First, a Boeing 737-700 is to be stationed at the Son Sant Joan airfield following which, 65 weekly flights to Germany and Switzerland will be available for booking. Further destinations planned are Holland and France. The airline Germania has been well-established for over 30 years in Berlin, and carries 2.8 million passengers annually.

 

Tourism III: Mallorquin Airline “Air Europa” goes USA

 

The highly successful Mallorquin entrepreneur “Hidalgo” is planning an international expansion with his airline Air Europa, which is based in Llucmajor. They will be expanding internationally and have targeted the US. As from the summer of next year, Air Europa will fly from Madrid to Boston on Wednesdays, Fridays and Sundays. In addition, there will be 20 other destinations in North and South America on their programme.

 

Tourism IV: Mallorca’s hotels reported 70 % occupancy in the month of October

 

 “Golden October"- also for Mallorca’s hotel industry, almost 800 hotels were open with 70 % occupancy. In addition to the absence of other holiday destinations, the hoteliers see the reasons for the extended season mainly in the investment they have made in the hotels. Spacious SPA areas and other similar amenities prompt the guests to travel to Mallorca even when the high temperatures are gone. In the coming winter season, Mallorca’s hoteliers want to invest a further 300 million euros in their hotels in order to improve the offer.

 

Gastronomic: Michelin awards Michelin stars to two restaurants in Mallorca

 

 The suspense is over; Michelin awards its stars for the new Michelin guide. Two more restaurants enter the elite Michelin circle. One of which is the restaurant “Agos” in Port de Pollenca with Chef Alvaro Salazar and the other restaurant “Quetglas” in Palma, with chef and owner Adrian Quetglas. The other restaurants with a star in Mallorca are: Simply Fosh in Palma, the restaurant of Andreu Genestra in Capdepera, the Es Moli d`en Bou in Sa Coma, the Raco de Teix in Deia, the Jardin in Alcudia and the Es Fum in the Hotel Mardavall in Portals Nous. The top chef of the Michelin Stars is Fernando Perez Arello from the “Zaranda” at the Hotel Son Claret in Es Capdella.

 

(3) The law taxes and finance

 

The Spanish S.L. -An investment model when buying a family home will soon be discontinued

 

Until 2007, the Spanish limited company was an interesting option when acquiring a Spanish property. The main reasons being taxes: if instead of the property the company's shares were sold (share deal), no real estate transfer tax was levied, if the property was sold by the company, the company paid only 15 % corporate tax on the profit, while the non-resident private owner of a property paid 35 % tax on profits. In the meantime, the legislators have put a stop to both "tricks": In the sale of shareholdings of companies now the property transaction tax is paid and corporate tax on the profits of the sale of the company's property amounts to 25 %, while non-resident owners have to pay only 19 %. For these reasons the model S.L. is a thing of the past.

 

However, many property owners did not use the possibility of transferring the property to private property, keeping the property under the regime of S.L. and rented the property at a reasonable price (otherwise it would be a taxable and hidden benefit). This fiscal model is also close to its end: the German Federal Court of Finance has recently ruled in three judgments that the private use of the property is not taxed as a rental value "usual in the market" but rather requires that the SL and users will agree and pay the higher costs. Council: Liquidate immediately the S.L. Ask your Tax Advisor (BFH I R 8/15; I R 12/15 and IR 71/15 Judgments).

 

Planned property law threatens banks and property developers with penalties for empty resident housing

 

The socialist Balearic government wants to intervene in the housing crisis, particularly in and around Palma by taking drastic measures.It threatens real estate developers and banks with interventions similar to the expropriation of homes that have been vacant for more than two years: if the flats are vacant more than two years, they must be "assigned" to the government of the Autonomous Community. The corresponding ministry is allowed to rent the apartments at social rent levels for three years. In this way, "people who are looking for flats will have the opportunity of a dignified life". Builders and banks have to inform the government of their vacant housing. Penalties for infractions of this requirement may amount to € 30,000. Availability will be checked with the help of companies that supply gas, electricity and water or with reading consumption in apartments. The bill also provides that banks cannot evict defaulting borrowers but will have to offer them leases. It can be assumed that the bill will be revised in reference to its constitutionality because here the constitutional rights of the protection of property and the guarantee of the social state collide.

 

Ignorantia legis excusat! Ignorance does not protect you from punishment – “Maybe sometimes”

The Spanish courts

 

It is an old principle from Roman law that ignorance does not protect against punishment (Ignorantia legis non excusat), that is, an accused cannot rely on the fact that he did not know the corresponding legal regulations. In other words, every citizen is obliged to know what is permitted and what is not. The object of this type of error is a large field for criminal lawyers. A German real estate owner sold his villa with a large profit, but only declared 3 % of the final price of the sale in his account A. He had good lawyers (de la Mata and Buades) and luck: although the prosecutor's office asked for a two-and-a-half-year sentence of imprisonment, the accused was acquitted of tax evasion. The court had doubts as to whether the accused acted intentionally. It is not to be refuted that he acted in good faith and thought that the payment of 3 % his tax liability was covered. City of Palma presents the budget for the year of 2017

 

After long internal discussions, the city of Palma has now presented its budget draft for the year 2017. Nearly 412 million euros are to be made available for municipal expenditure in the coming year. It is the highest budget since 2011, and it is 6 % above the spending of the current year. Emphasis of the budget is on social projects, employment schemes for young people and investments in health care. Savings relate primarily to public services.

Since the beginning of the year the charity organisation ASPANOB (a charity which supports parents of children with cancer) has held a series of golf tournaments known as “Golf con Corazon”.   Minkner & Partner is one of the main sponsors for this charity, and 300 people took part in this event on various golf courses such as  Alacanda, Son Antem, Camp de Mar, Son Gual, Puntiro, Maioris as well as Poniente.  This year 44.000 Euros were raised, and donated to the charity ASPANOB. 2. Mallorca – Construction, Economy laws and taxes

 

(1) Construction / Investment

 

Palma: Es Jonquet windmill owners must restore them

 

The ruins of the windmill in Es Jonquet above the harbour promenade of Palma have been an eyesore for decades. The city council is now urging the owners of the listed windmills to restore them. Previously, the city council had modified the development plan and allowed the use of the mills and the annexes for residential purposes, as the owners had intended, but as of yet nothing has happened. The municipal authorities have now advised the owners that according to the Act on the Protection of Historical Buildings they are obliged to keep the listed buildings in perfect condition. Expropriation was also discussed however the city council lacks funds for the necessary compensation.

 

Andratx  - Sant Elm/San Telmo: Coastal town gets second exit

 

In the charming fishing village of Sant Elm, on the southwest cost of Mallorca, roadworks are underway. These works are taking place along the Cami de Sa Font dels Morers in order to create a second exit. Until now, the small coastal town has only been accessible by means of a winding mountain road, which has only one lane for traffic in both directions. This leads to congestion especially in the summer season. With the restoration of the Cami de Sa Font dels Morers there will be a second exit, which will make the traffic flow much better.  Andratx council, to which Sant Elm belongs, have announced that a further seven roads will be repaired and resurfaced.

 

(2) Economy

 

Tourism I: Airport reports passenger record for the month of October

 

Once again for the month of October 2016, Palma’s airport has announced a new passenger record. This month, there were 2,773,585 passengers, which is 17% more than in the same month of the previous year. The figures for the period from January to October 2016 are also definitive: during this period, 24.7 million passengers arrived to or departed from Son Sant Joan which is an increase of 11% in comparison to 2015.

 

Tourism II: Good prospects for 2017 following the World Travel Market Exhibition

 

Travelling educates! A large delegation, headed by Francina Armengol President of the Balearic government, director general for tourism Pilar Carbonell, tourism minister Biel Barceló and Director ATB Munoz, visited the World Travel Market in London. Despite Brexit, in 2017 there is an expected growth in tourism of 20% from the UK. At the same time the Melia Group presented the Congress Palace, as they are the new tenants. In the first five-year plan up to 2021, it is expected there will be 320 congresses/seminars and 77,000 participants. Congresses (Seminars) are already planned as far ahead as 2020.

 

Tourism III Palmas harbour is expecting for 2017 an increase in passengers of 15,89%

 

After a record year 2016, Palma's port expects a further increase in passenger volume of 15.89% for 2017. This was announced by the Port Authority after the major cruise companies such as AIDA, Costa, MSC and Thomson have notified their plans for 2017 and have booked berths accordingly. In 2016, there were 555,620 passengers who checked in and out of Palma, there will be 643.918 in 2017. The passengers checking in and out are particularly interesting for Palma's tourism industry, as they often extend their holidays for a few days and book hotels in Mallorca and therefore also spend more money.

 

Tourism IV: From 2018 onwards, cruise ships also will be docking in area of Cala Ratjada

 

Cruise ship tourism brings a lot of money to the island. However, voices are getting louder and louder, calling for a reduction in the number of ships that sail on the same day to Palma's port. The mayor of Cala Ratjada, the Port Authority and the Balearic Government are working on a plan so that cruise ships will also dock in the bay of Cala Ratjada from 2018 onwards - not in the harbour, but on a buoy. In anticipation of the new flow of tourists, Cala Ratjada’s town council is developing plans to expand the shopping and gastronomic offer and two new hotel or extensions to existing buildings are also being discussed.

 

Fan Mallorca Shopping: opening of cinema complex with eight cinemas

 

Mallorca's new shopping centre FAN MALLORCA SHOPPING, opens a new attraction: a cinema complex with eight cinemas and 1,200 seats. The cinemas feature state-of-the-art technology with a 4-D experience, laser projectors and Dolby Atmo sound systems. The programme can be found on the website of www.artesiete.org.

 

25th of November 2016 – Discount battle “ Black Friday” in Palma

 

On "Black Friday" – a discount battle between retailers - the Christmas shopping begins in the USA. It takes place on the Friday after Thanksgiving and was first held in Philadelphia in 1966. Over the last few years, Palma’s stores have also adopted this custom. They advertise huge price reductions and want to open their shops until 23.00h. Many retailers want to continue the Black Friday until the Sunday sales (27th of November). Many online shops also participate in the campaign. Palma's city administration wants to turn on the Christmas lights on Black Friday. The left-wingers of the city administration, who do not have much to do with the economy, have now moved the switching on of the Christmas lights to 2nd December.  So, in reality, Black Friday

 

(3) The law taxes and finance

 

The tax authorities are asking owners of rental properties who are not paying taxes, to pay up

 

Many owners of apartments and houses rent out their properties on a regular basis to holidaymakers, without registering and without paying tax on their income. The review by the Spanish financial authorities was in the past rather superficial. In addition, the legal situation regarding the legality of the holiday rental was very different. Since the entry into force of the Tourism Tax Act this year, the owners of rented apartments and houses are obliged not only to pay income tax on the rental income, but also to collect the tourism tax from the tenants. Due to the non-payment of these two taxes the state loses a considerable amount of money, and so the financial authorities have dug deeper and have approached numerous landlords and requested information. 60% of the mentioned landlords have now made further explanations and thus avoided the imposition of a drastic monetary fine. Apart from the internet and other publications, the financial authorities were given the most clues as to "black landlords" by dear neighbours.

CONSTANTIN RAHMFELD - Photography - “fiestas on Mallorca” - kings, devils, giants, penitents, and the magic of the fire

 

The Minkner art gallery is holding, for the first time, an exhibition of photographic art work by the young photographic artist, Constantin Rahmfeld. There are two reasons, the first one being, that photography has been recognised as art in the artistic world and the second reason being that Constantin Rahmfeld has worked for Minkner & Partner for the last eight years, and we think that his work should be introduced into a wider circle.

 

Mallorca is the island of “fiestas”! Nearly every local village has its own patron saint and fiestas are held in their honour. On these mystical, bustling and happy occasions, Constantin Rahmfeld loves to capture the special moments with his camera. The photographs for this Exhibition were taken on such occasions, where only the camera and the photographer hold the moment, forever. Whilst looking through the photographs a quote from Friedrich Dürrenmatt comes to mind:

“Anyone can take a photograph. Even a machine. But not everyone can observe. Photography is only art when the artist portrays it correctly. Observation is an elementary poetic process. The reality must be formed, to be brought to life.”

ELENA GATTI and Peter Thoms - from graphic to abstract

 

One aspect of the history of painting of the 20th century is the shift from figurative representation through several development steps to a gradual abstraction whose ultimate goal was the complete disintegration of the graphic. The result is an autonomous artistic statement. The Minkner Art Gallery in Santa Ponsa offers a new collective exhibition by the artists Elena Gatti and Peter Thoms, who follow the path from graphic to abstract through their work.

 

Elena Gatti was born in 1950 in Argentina, and now lives and works in her adopted home of Mallorca. By sketchy allusions and overwriting them to evolve forms, light and shadow, and thus comes to new perspectives of objects and people. It stimulates the imagination of the viewer, creating "works for immersion".

 

Peter Thoms, awarded the Ruhr Prize for Art and Science, is a master of the game of colour and light, which he uses almost playfully to resolve the representational and abstract. From the Middle distance itself developed from the ordered chaos arises.

Jürgen Wölke - RETROSPECTIVE "assemblages - The world in miniature"

 

The artist Prof. Jürgen Wölke died in 2010. His main body of work was assemblages - patio-plastic material images reflecting what he calls "the world in miniature“. Large-scale works are located, for example, in New York's airport and at Leipzig Central Station as well as in numerous private collections. The Berlin Senate have presented numerous state guests with a Wölke assemblage as a gift.

 

Wölkes most common motives were those of his time battered facades of the German capital, small traditional shops, the Berlin corner pub and scenes from the lives of ordinary people. This work Wölke continued on Mallorca. Again, he found in the capital Palma facades and subjects worth replicating, and he created sensible environmental studies of documentary value. The largest German private collection of Wölke’s work is owned by the bankrupt entrepreneurs Schlecker and was dissolved as a result of the insolvency process.

 

Edith and Lutz Minkner were the main promoters of the artist and part of their Wölke collection is on show in Llucmajor.

1. News from Minkner & Partner

 

Minkner & Partner – Office Pto. Andratx – New Opening on the 19th of December 2016

 

As already announced, Minkner & Partner will be expanding at the turn of the year in Pto. Andratx and taking over new, larger business premises. The new premises are located directly on the harbour promenade opposite the fish market in Avda. Mateo Bosch No. 8, Local 2 (previously business premises of lawyer and broker Gaspar Alemany Ferrer). The reconstruction work is in full swing and the move to the new premises will take place on the weekend from 16th - 18th December 2016. With the acquisition of the new premises Minkner & Partner will have top quality, additional experienced staff in their new offices who will be preparing for their new tasks in the run up to the opening of the new Pto. Andratx office. In addition, international media and an extensive marketing campaign will introduce the new location in Pto. Andratx to the public. After a soft, low key opening, a grand inauguration will take place on 24th February 2017. In addition, a special issue of the Minkner & Partner magazine MALLORCAS TRAUMIMMOBILIEN will be published (also as a supplement to the edition of the Mallorca magazine), which will be published on the same day.  This will be exclusively related to the real estate market of Pto. Andratx and Camp de Mar.

 

2. Mallorca – Construction, Economy laws and taxes

 

(1) Construction / Investment

 

Palma: AENA invests a 100 million in Son San Joans Airport

 

The operating company of the Son Sant Joan airport will invest 100 million euros in the construction of the airport next year. A free short-term parking space is to be constructed in the arrival area of Palma’s airport. The approximately 80 parking spaces are expected to be available this coming spring. In addition, so-called family rooms will be built in which families with children can spend time whilst waiting for their flight. The airport will also provide facilities to re-charge all electronic devices. A huge project is the renewal of the asphalt for the southern runway.

 

Palma: Congress Palace – Four Star plus hotel “Melia Palma Bay”

 

Guests of the new hotel "Melia Palma-Bay “will access the Congress Palace via a bridge. The hotel has 268 rooms and suites, a large spa area and a rooftop pool. It will be run as a 4 Star plus hotel, although it offers the standard of a 5 Star hotel. As Gabriel Escarrer reported, many companies who hold seminars, have an ethical code not to use 5 star accommodation, therefore they go one lower and use a 4 star or 4 star plus.

 

Palma: Provisional off for Son Averso golf course near Palma

 

For the past eight years, the Son Averso golf course has been in the planning at the entrance of Palma. A golf course with 30 holes, training facilities and a 5-star hotel are planned. The Balearic Islands Environmental Commissioners has now voted against the approval of the planning. The project is "unreasonable „and as this is one of the most important natural areas in Palma area.

 

Pto. Soller: "Completely in White" - planning for new port buildings was presented

 

The construction work is scheduled to start in the autumn of 2017; the new port buildings in Pto. Soller should be completed. The design of the flat buildings with horizontal lines, which was now presented, is by the architect Alberto Martin. It dominates the colour white; the materials are glass, concrete and sandstone. A 300 m² building is reserved for fishermen and fishermen. The storage area, cooling area as well as sales offices and a area for freshly caught fish as well as dressing rooms. In a separate area, the fishermen can repair their nets and dry them. A total of 67 parking spaces are being built. Three further buildings are planned for administration of the port, a diving school, a restaurant and a bar. The built-up area will be 1,200 m². The total investment is stated at 4.5 million euros.

 

 

Santa Ponsa: The tourist resort Santa Ponsa is building a seafront promenade

 

Calvias local town hall is planning to build a new seafront promenade from the restaurant “The President” up to the Santa Ponsa boat berths.  The second phase of construction will be continue on to Es Castellot, along the east coast of Santa Ponsa´s bay.  With the expansion of the beach’s promenade the previous access difficulties to the bay will no longer exist, making this route more accessible in the future for tourists as well as residents.

 

Cala Millor: Improvements for the seaside harbour town of Cala Millor

 

Cala Millor wants to change its image for the next summer season. The administration of the local community of Son Severa will be investing €630.000. The budget also includes the renewal of the main roads in the town which includes the  Avenida Joan Servera Camps.  New trees will be planted and the streetlights renewed. In the Carrer Rafalet, a new road surface is to be laid and potholes removed. Finally, the coastal promenade between the streets of Pula and Sipells will be improved.   

 

Hotels: an additional 300 million euros will be invested in modernization

 

Nearly 700 million euros have been invested by Mallorca's hoteliers in the modernisation and complete refurbishment of their hotels over the last four years. During the next 6 months (winter) a further 300 million euros will be invested, so that the total investment will be just fewer than one billion euros. The basis for this investment was a law passed by Tourism Minister Delgado, which allowed hoteliers to increase their businesses in connection with modernisation measures. Similar investments are not to be expected in the future, as the current left-wing government has significantly restricted the possibility of an increase in the number of hotels. In 2 ½ years elections will be taking place.

 

(2) Economy

 

Tourism I: Mallorcan winter flights 2016/2017 - 36,000 flights with  5.6 million offers

 

The 2016/2017 winter timetable for the period from 30th October 2016 up to 25th March 2017 also sets a new record: It offers 36,000 flights for Mallorca’s guests with seats for 5.6 million passengers. With respect to the number of flights, this is an increase of 5.1% compared to the previous year, and the number of seats shows an increase of 3.3%. 115 different destinations are targeted. The preferred countries are domestic flights to Germany and the UK

 

Tourism II: Foreign investors are increasingly buying hotels in Mallorca

 

The newspaper Ultima Hora reports that foreign investors have already invested 260 million euros for the purchase of hotels on the Balearic Islands in the first half of the year. This is nearly twice as much as last year and in previous years. Investors are predominantly tour operators and tourism companies who want to place their customers in their own properties, where they can determine the price policy themselves. Of the total investment sum, 142.6 million euros are attributable to investors from Germany , such as Alltours, TUI and Thomas Cook.

 

Tourism III: Hoteliers are highly satisfied with their occupancy capacity in September

 

 September 2016 was highly gratifying for Mallorca’s hoteliers. Both the occupancy of their hotels and the income per bed / night are much higher than the Spanish average, according to the official Spanish statistics institute. In September 2016 Mallorca was able to welcome around 1 million tourists, which led to a utilization rate of 92%.  On average the price for one night is € 95 per room (price increase to the comparable month of the previous year of 9%), which means that Mallorca took the leading position.

 

Unemployment rate:  10% unemployed in the Balearic Islands

 

The unemployment rate in the Balearic Islands has fallen. In the third quarter of 2016, the average unemployment rate fell to 10.6%, making it the lowest in Spain. In Spain, the average unemployment rate is currently 18.9%. In the Balearic Islands, this means that currently 67,900 people are registered as unemployed, which is 14,100 less than in the previous quarter. These figures have now been announced by the Spanish Institute of Statistics (INE)

 

Congress Palace: Congress Palace and Hotel to be opened by March 2017; 200 new jobs are created

 

The Melia hotel group has been awarded a contract for the running of the Congress Palace on the outskirts of Palma and its affiliated hotel. One of the conditions of the award is that the hotel should be fully operational as early as March 2017. Melia are in the middle of the preparations and have already taken bookings for the coming year. As the Melia Hotel group reported, 200 new jobs will be created with the commissioning of the complex.

 

Solar Park in the municipality of Manacor is to be developed in a lesser form

 

German investors, who leased the estate of Santa Cirga with the purpose of creating a solar park, presented the first draft to build the park in a reduced form because of the protests. This month, the modified project should open to public inspection and then await approval from the state government. The operator Cirga Santa Photovoltaic Park S.L. belongs to the German company KS Management Investor. Unlike the original plan, the new plan uses only 56 hectares instead of the original 90 hectares. The number of modules has been reduced from 250,000 to 190,000.

 

(3) The law taxes and finance

 

Property tax: Who owes the local rates when selling a property?

 

A frequent bone of contention when purchasing a property has always been the question of who is responsible for paying the rates for the current year, if the house is sold in the middle of the year. This is based on Spanish law according to which the person who is owner of the property on the 1st January of the current year is liable to pay the costs. Minkner & Partner had always solved this issue in the past in such a way that both parties agreed in the purchase contract that they have to pay the local rates pro rata for the property in the current calendar year. This legal practice has now been confirmed by the Supreme Court of Spain by a judgment of 15 June 2016:  if on the 1st January of the current year the seller has paid the rates he may request the pro rata refund from the buyer. Only if the parties expressly exclude the application for reimbursement in the purchase contract, the claim no longer applies.

Jürgen Wölke - RETROSPECTIVE "assemblages - The world in miniature"

 

The artist Prof. Jürgen Wölke died in 2010. His main body of work was assemblages - patio-plastic material images reflecting what he calls "the world in miniature“. Large-scale works are located, for example, in New York's airport and at Leipzig Central Station as well as in numerous private collections. The Berlin Senate have presented numerous state guests with a Wölke assemblage as a gift.

 

Wölkes most common motives were those of his time battered facades of the German capital, small traditional shops, the Berlin corner pub and scenes from the lives of ordinary people. This work Wölke continued on Mallorca. Again, he found in the capital Palma facades and subjects worth replicating, and he created sensible environmental studies of documentary value. The largest German private collection of Wölke’s work is owned by the bankrupt entrepreneurs Schlecker and was dissolved as a result of the insolvency process.

 

Edith and Lutz Minkner were the main promoters of the artist and part of their Wölke collection is on show in Llucmajor.

3rd until the 12th of November 2016, Evolution Film Festival in Palma

 

From 3rd – 12th of November the “Evolution film festival” will be taking place for the fifth time in Palma. Over a period of 10 days there will be 69 short films and feature films as well as music videos. There is an extensive supporting programme. Films are mainly shown in the “Cine Ciutat. This year’s host of the event will be Germany. Tickets for the event are sold individually and cost between 5- 10 euros, festival passes are 75 euros 3rd -12th of November, “Evolution film festival”. 6th of November 2016,“Reise nach Wien“, (Journey to Vienna), Pianist Natalia Ehwald will perform at the Cultural Finca Son Baulo, Lloret de Vistalegre

 

On the 6th of November the pianist Natalia Ehwald, well known worldwide for guest appearances and international concerts will appear at the cultural finca Son Baulo in Lloret de Vistalegre. 13th of November, Maya Ando ( Japan) is holding a piano concert at the cultural Finca at Son Baul,Lloret de Vistalegre

 

Maya Ando studied at the Music University of theatre and media in Hannover. In 2014 she performed as a soloist at the festival in Bayreuth and received the highest recognition in the European area. This was followed by prizes in Italy, France and Germany. On 13th of November the artist will be playing the most beautiful piano works.  On the 13th of November 2016, pianist Maya Anda (Japan) will be guest at the cultural Finca  Son Baulo.
